    • Default Amount £9237.88, all this started in 2006 Admitted debt £9075.65 Weightmans added £1515.01 immediately they became involved, no explanation The Statement shows when Marlin bought debt in May 2011 £10439.25 Their statements, not received until the SAR, are based on this. Cabot deducted £1515.01on their statements in January 2019, again did not find this out until SAR. Weightmans added in  2007 after the CH1 etc was confirmed by the court £741.50, made up of Process server fees, Court Fee (they tried for bankruptcy), Solicitors fee and Land Registry fee. Unspecfied Legal costs were added by Marlin in March 2015, again I did not know this until statements received with SAR I had been paying monthly, without exception until December 2018. I am minded to take the property charge, CH1 amount ,deduct all my payments and the subsequent fees, and request/demand a refund on the final payment made? I consistently disputed Weightmans balances, but they never responded. I also told Mortimer Clarke/Cabot that I disputed their amounts.

    • Sorry,  I'm not familiar with terminology.  Direction questionnaire is what I've seen online as next step. Witness statement: I haven't gone that far, that's why I put the question marks.

    • Confirmed with Central Contact Centre that the hearing is 24th, disappointed I can't speak directly with the local county court I have to email the local court apparently is the only way. The agent couldn't explain the discrepancy between the two letters, she sounded very confused. If they were identical letters in wording but only dates were different I would feel ok, slightly worried the wording differs...

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi beachy, i send everything recorded to these bankers and after reading through various threads yours included, i know the battle against them probably won't end any time soon but thats ok i'm up for a long fight if need be:D

Received this letter from debitarse this morning.

 

You must read and respond to this letter immediatly

We recently sent you a letter asking you to pay the outstanding balance you owe on the above Capital One account. However, you failed to make payment or call us.

 

We are concerned that not by responding you may be risking further action being taken to recover the outstanding debt.

 

As you have not responded to our previous letter, one of out agents will be calling your home within the next seven days to discuss your debt.

We will cancel our agent calling if yiou contact us first. We want to set up a payment agreement with you to sort this out. Our telephone number...........

 

 

Would it best to send debitarse the 'bemused' letter now and maybe also the letter warning them off a doorstep visit:mad:?

I received the letter below from a company called power2contact today any suggestions on what i should do?

I would send them account in dispute letter again in this case or if you have send them already by registeredmail then probably ignore them.

But just to see what they do next send them account in dispute letter and copy of this letter .lol

I sent the doorstep visit letter today by recorded delivery like everything i send to these bankers which probably comes to quite a bit of money now:rolleyes: didn't send a/c in dispute letter as crap 1 have it all on record anyway. Should power2contact decide to send one of their ''contact managers'' to my address then i shall give them a copy of the letter i sent before telling them in no uncertain terms to move their arse off my property before i put my foot right through it:mad:

 

Sorry about don't know what came over me then stresfull day i guess! Will keep you updated and wish you look with your disputes, you never know they might actualy listen to what we tell them one day (fat chance i know)

Hi just an update.

 

Well just before setting off for work this morning i had a visit from one of debitarse's monkeys which was quite unexpected especially at that time!

He didn't stick around for long though as my two dogs went completely mental like i've never seem them before just as though they could sense who was, mind you it could have been the smell:D

 

He basically said he was from deibtarse to which i replied quite calmly with, the account is dispute and if you don't p*** off i will call the police and have you removed for trespassing to which he replied ok bye and left. I couldn't help the swearing bit just came out as i'm not the best of people to be around in the mornings especially when i have one of their muppets to deal with first thing:mad: although i don't know where he came from as there wasn't a car in sight must have hid it i guess, which was a Shame cus i was going to take a photo of his car and number plate:rolleyes:

I Have received a letter from crapone sayibg they have not received any CCA request (got proof) and they want me to send about £15 cheque so they will send me statements CCA and Subject access.

Are they running one step ahead of me????????

(i certainly will not send them cheque because they will copy my signatures lol ) but will send them PO.

Most Important of all I am waiting your advice on it.

Please get back and guide me .

I'd think it should cost you £11 tops, £10 for the SAR and £1 for the CCA.

Hi All

 

No I have not received any CCA from them. One account manager of crapone wrote me that he could not find my account to provide me CCA. Sent him the photocopy of his letter and the cca request letter.

 

Then the above letter manager (another) says he cannot see such request has been made ever.

lol

Dont these guys talk to eachother>

it is amazing i will send him the copy of the first manager letter where he sates that thank you for your request for CCA under section 78 of CCA..blah

And £10 PO of SAR.

Lol! Yes Debitarse and Barclayshark are DCAs that do not always bluff about doorstep callers! LOL,They do send real humans round!:eek: and ive had a s couple too! but ignore them or as you found just tell them to leave and they will retreat!:D

Hi all

 

Well i had another letter from debotarse on friday whom seem to be getting more and more desperate with their scary threats:rolleyes: i wish they would just pass it on to an external dca instead of keep threatening to do as i can have some fun with someone new then as i'm a bit bored of debitarse now. Don't mean to sound like i'm getting cocky cus i'm not, but it is strange really as i'm actualy starting to enjoy this taking the banks on business!!!!

 

I've also noticed they state ''Call us with your offer'' could this be of interest? Anway here's the letter below.

 

 

NOTICE OF IMMEDIATE ACTION

We are planning immediate action against you. As we previously informed you, this may include passing on or selling your account to an external Debt Collection Agency for failing to come to an arrangement to repay the amount you owe Capital One.

 

In a final attempt to avoid this action, you have one last opportunity to repay this debt by calling us immedaitely to discuss repayment

 

Call us with your offer on 0845........... we are here 8am-9pm Monday to Friday and 8am-6pm Saturday and Sunday.

 

This is your final opportunity. Failure to take any action may have serious consequences.

Great that sounds a victory!:D However be prepared for a merry game of pass the parcel with your account from crapital one as they pass it from one scummy DCA to another as they desperatly try and get some peanuts back for their most probably completly legally unenforceable debt and you will get plenty of use from your printer!:D A lot of people in Crapital one getting Lowell at moment though to date i have got of pretty lightly with crapital ones pass the parcel game but no doubt they will be from crawling under their stone to set a pondfeeder on me sometime! :rolleyes:
