Wrote a letter to Intelligent Finance asking for list of all charges. They sent this. But it says they are not required to send info. Please could some read and get back to me, cause im sure the list they have sent, are not all the charges.

 

Thank you for your request to access the information we hold about you. Which is your right under the Data Protection Act 1998. I note your request for a list of all charges applied to your account on the above plan. Please note this is not classed as personal information therefore we are not required to provide this as part of the DSAR. I have however detailed below a summary of any charges applied to your account and the date of application. There is no charge for this service on this occasion.

Did you use the standard template letter?

Amex to Remove Default - acknowledged didn't issue correct documents - default removed :) . £135 paid in full without Court

Of course its classed as personal information.......it relates to information they hold on you and your accounts.

 

As they have agreed to send it then you can only wait.

Refunding the fee is nothing new.

 

You can either wait for them to send the statements,or send a more even handed letter reminding them the clock is ticking.

 

Maybe something like

 

Dear...

 

I acknowlege receipt of you letter of ..... in response to my request for full subject access under the data protection act 1998.

 

May I remind you ,that you have a requirement under the act to comply with my request.

I look forward to receiving copy statements or other intelligible form of transaction details from my account No........... between the periods ...........

 

I note your comments that these will be supplied free of charge..

Is the summary not enough ? or do you doubt that its true? If you could just use the summary it would save you lots of time and effort searching through about 200 pages of statements. It still should include the interest charged as well.

Been on hol for a week, got home found letter from them dated
27/6/06 offer of £92 claiming £1155.10 so no deal.

Filed claim with Moneyclaim 12/07/06

Halifax acknowledged claim 25/7/06

Court papers received 28/7/06 Halifax intend to defend.

HALIFAX SETTLED IN FULL 1/8/06

Donation made

Birmingham Midshire (mortgage charges) Prelim letter sent 2nd Aug 2006, full offer received 11th Aug with conditions.

13th Aug accepted offer unconditionally.

BIRMINGHAM MIDSHIRES (MORTGAGE) SETTLED IN FULL 24/8/06

Sent SurlyBonds template letter to get defaults removed to Birmingham Midshires 27/08/06

DEFAULTS REMOVED 5/09/06.

The summary is OK up to a point, but you won't be able to work out interest charged on charges without knowing the individual amounts and dates. You also have no way of telling if the amount is correct or covers the entire timespan of the account. Point out that you will be filing a claim for their breach of their DPA obligations if the full requested information is not supplied within the laid down timescale. I'd also be inclined to ask them why their parent group can supply this information to Halifax & BOS customers but they can't.

Well have they actually sent you a summary that you can understand clearly ?

Do you agree that its a fair assumption of what they took from you ?

Does it cover all the periods of the account that you need ?

 

if yes to all of these then by all means.......do a charges schedule and send off the prelim.

If you got the main account info then no point waiting around !!

Agreed, but still keep up the pressure on the missing DPA information. This seems to be a common IF tactic currently.

They seem to have their own variations - with Abbey & Barclaycard it's microfiche, with IF it's 'charges aren't personal data', and so on. Halifax don't attempt to wriggle out of it - and they are IF's sister company. Makes you wonder about left & right hands... ;)

The microfiche arguement runs on...........

Barclays have no problems with accounts yet Barclaycard say only post May 2004

 

By their own admission tho they say they are able to supply them in alternate form at 3 quid a time.

This alternate form therefore suggests that they DO have other means of filing.

 

Its a good job (or at least from their point) that the limitations are protecting them pre 6 years.

 

I cant imagine what sorts of excuses we would have if they were asked to supply data from 10 years ago ???

just phoned them and asked them for the interest charges applied to my account, they said go and look them up on the internet. Cool i thought, but this only went to feb 2006, straight back on the phone, got them to send me the required info, spoke to the manager, nice man, got to abide, But he said it will take 2 weeks to get the info....ummm. - is this right 2 weeks!

Statements/letters/archive etc etc.

hi all!!

spoke again to IF and asked why my missing information hadnt turn up yet, they said they left a messsage, saying they dont supply this information, and if i wanted this info it would be in the form of statements and they would charge per statement, i said the personal disclosure request on my account wasnt complete, they left me on hold for ages. and then said they had left a email for some to look into this......NOT happy.

Basically i have a list of charges but no debit interest.

Please advise if im barking up the wrong tree!

Because on my statements there are charges and debit interest, can i claim for this???????

Send them a prelim letter for what you have so far and put in a bit where it says 'I am claiming £x and £x in interest...' finish it off with ' and I reserve the right to amend these values as new information and / or charges come to light.'.

 

Keep chasing them on the DPA data as well, and inform them that if they can supply the statements then they should be supplied under the existing (paid for) DPA request in lieu of what was originally requested and NOT at extra cost.

Hi, Had a lovely long winded letter from Intelligent Finance in response to my LBA

 

Basically saying there charges are fair, and it my responsibilty to keep an eye on my monies. :-x

 

Feel like sending one back saying "but you dont keep an eye on my money either, your computers do, and it the computers that automate these charges, and line your pockets":?

 

So what now!!!!!!

 

Could a lovely mod move this to the intelligent finance forum, Cheers

Just an UPDATE!

 

Had an offer from intelligent finance for 25% of what they owe me, sent a reply straight away, saying that i would only accept this as a partial offer and would persue the rest of my claim.

ok been back to court today and filed for judgement, they it will take a few days to a week to process,

 

What happens now, the man in the courts gave me 2 forms one called request for attachment of earning order, and request for warrent of execution...

 

Im totally losted. Can someone please help!
