Is't not automatic up here, with northampton county court.

 

As above scott rec'd the above but obvioulsy they didnlt realise that they cannot persue through english system for someone in ecosse

Does it matter if debt is enforceable or not?

being named in the same sentance with Rory scares me :oops: lol

 

had a look through search but not much in the scotland forums but not meant to say that people may have posted etc on other forums and live in ecosse.

 

but reading the forums it looks as though they like their ccj's down south

I don't think I've ever seen Howard cohen getting involved with a debt north of the border and one quick search confirms this.

 

Its must be a problem for them.

 

The same question keeps coming up....why?

probarbly because the court system is different up here and they would need someone up here to go through the process. - maybe to costly for them.

the thing is they would need someone up here to deal with it and obviously is aware of scot's procs.

 

as with scott they tried to issue proceedings down there on him up here and it doesnlt work and then they left it.

I kinda see your point but say for example a 25k debt that is enforceable this would be worth while, yet I still see very few, if any cases. There has to be more to it than this?

Really as the title says who deals with Howard Cohen/CL Finance dirty business when its over the border into Scotland?

 

I really need an answer on this one guys, if anyone can help.

yes every page...sad I know.

 

So lets get this straight £25k worth of debt goes north and based on what i've read HC/CL Finance simply say 'oh well'

 

They must have a plan other than Northhampton. I can't believe they don't?????

First off I'm in Scotland and this small detail is why they have not taken the usual CL Finance route and gone to court but now I receive a letter saying.

 

'We refer to your allegations that the debt is not enforceable etc etc.

 

...we have previously provided you with worthless CCA, etc unfortun.. the T&C's were not included (they were) so we now send them.

 

Why are CL suddenly focusing on sending T&C's what difference does it make? What are they up to???

 

I live in scotland they have bought a turkey? What is the point????

They focus on trying to play mind games to make you unsure, put you off balance and weaken your resolve.

 

Also in scotland I think that from 1 dec (not sure of date) they are required to lodge a true copy of the original CCA with the court in order to begin action. So this could be a last hurrah before they have to write off the loss.

Just thinking out loud. If they started the claim in Northampton and you defended, it would I assume go to a Scottish court. Would the same apply?

This is my principal or main home and I am domiciled here for the purpose of section 41 of the Civil Jurisdiction & Judgments Act 1982 ('the 1982 Act').

 

 

I entered into a contractual agreement with the plaintiff as a consumer.

Paragraph 3(4) to schedule 8 of the 1982 Act provides as follows:

"(4) Proceedings may be brought against a consumer by the other party to the contract only in the courts for the place where the consumer is domiciled or any court having jurisdiction under rule 2(i)".

 

 

Rule 2(i) concerns moveable property which has been arrested and is not applicable.

Paragraph 3(6) does not apply.

 

 

Accordingly, this action is incompetent for want of jurisdiction

and should be dismissed with expenses in favour of the defendant.
