Where do I start???

I was forced to move myself & my children out of my home by my ex partner back in Oct 07, we had split and was being harrased. I found a rental property & began seeking advice from solicitors. After many letters to my ex and lots of bills later i was getting no where as he would not respond. In Oct 08 he agreed to transfer the property into my name. The mortgage company dragged there heals and fianally agreed in Jan 09. In the mean time the mortgage payments were being missed and my ex has done a bunk & left the house empty. it was agreed the arrears would be cleared once the transfer had been signed by my ex & a condition built into the offer. We are almost at the point of signing and I have received a possession order with a hearing date looming. I have now also received notification of a charging order in respect of a debt that my ex has not paid. The sol's that are dealing with it at present don't seems to see the urgency and the lender well i never seem to be able to speak to the person dealing with it.

 

Does anyone know where I stand in particually with the charging order that is not in my name & that has come about since the transfer process started.

Where do you stand with the mortgage companys agreement to spread the arrears over time. ?

Has anything changed ? if not you could use this in your defence.

 

Im afraid if the charging order was granted before the transfer, its unlikely that you will get away without paying the debt. You need specialist advice on this one.

Tell the sols if they dont get off their ass, you will use somebody else.

NatWest Claimed £1,639. Accepted £1,344.

Natwest Paid me again as GOGW £1,656. Yes they can have it back if they say please.

Barclays 1 Claimed £1,260. Won by default. Paid in full

Barclays 2 Claimed £2,378. Won by default. Paid in full

Birmingham Midshires. Claimed £2,122. Accepted £2,075.
