    • I am getting conflicting advice from friends about this issue. I am hoping somebody can end my confusion. A couple of weeks ago I took my Mum out for her birthday. Another driver scratched the front passenger side near the bumper of my car as it was parked up. There are no dents just quite severe paint work damage. He scraped his car against mine. The other driver drove off. Luckily there was 2 witnesses who got the other drivers reg number. Cut a log story short the other driver said he didn’t realise he damaged the paintwork on my car. He has however admitted liability. His insurance is paying out. Last Thursday my car was taken away to have the paintwork done. Today I been told my car has been put down as a total loss (not a write off).  As it is only paintwork damage and not body work or mechanical damage, I don't understand why it has been put down as a total loss. I have been told by the insurers I can either write the car off and receive payment to the value of the car or I can take a lower payment and get the car repaired myself.   I am getting conflicting advice from friends. Some are saying if I keep my car and get the repairs done myself the car will then be classed as a category S or category M and I will no longer be able get insurance on the car as it will be classed as written off. As it is only paintwork damage and not body work or mechanical damage, I don't understand that. My questions are  If I take the payment to get the paintwork repair done myself will I still be able to insure my car when the insurance is up for renewal? If I take the payment to get the paintwork repair done myself will my current insurance policy be voided? If my car does get classed as category M or S will the stop me from selling it on the future?     • Yes, it is just for Tesco. But as that manager explained, those two spaces on that ground are now rented by the electric company. "What appeal?  Private parking companies never, ever, ever accept appeals - ever." What is my next move then, please? Just wait for them to issue me with whatever it is they issue, and then what?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

I don't know where to post this, so if it needs to be moved on or sent somewhere else then please can it be sent to whoever is redesigning this whole website.

 

The new front page is a nightmare for myself (and I'm sure I can't be the only one) with an older pc and slower connection speeds.

 

I cannot get it to load at all, even after waiting 20 minutes. The text is all over the place, overlaid on other text and it has crashed my browser 3 times before I could get the link to the consumer forums to click on.

 

Then these are loading very slowly now.

 

And the large screaming fonts - please, how about just making clear statements without the garish colours, totally unnecessarily huge font sizes and overworked asterisks??

 

And - is it not at all possible to have the page laid out so everything can be seen on one page without having to scroll from side to side?

 

Other web pages don't have this problem.

 

I am very grateful for this site and all the help I've gained from it and have been able to pass on to help others.

 

I just feel that all the tremendously good work is being let down by a totally unwieldly mish mash of content and design which really needs a radical overhaul so the site becomes far easier to load, navigate, and join in with.

Youve been here a long time so will have been used to the old one.Staying as the No1 Consumer site means moving with the times and introducing things that benefit rather than hinder,its unfortunate that for you this hasnt happened.Feedback is important and taken on board-I will let the team know of your comments.

Hi Martin, I do understand that everything must evolve, change, update etc to survive and appeal afresh.

 

But - without wishing to tread on your delicate tootsies (or miff those who do all the work to keep this site up and running), sometimes 'changing' doesn't always mean 'improving' - and sometimes the things which really need an update and a good old fashioned spring clean and fresh air, get overlooked.

 

I am on an oldish setup - I know it's my problem and I accept 'slow' as it's where I'm at. :|

 

But - as an example - I almost never have any problems scooting along inside Amazon, having several browser pages open at once. :rolleyes:

 

I'm on XP, but that's about as advanced as I've gotten for various reasons.

Yerrrs - well - I wish - but it's very low on the scale of needs right now.

 

I have got all me security stuff in place, antivirus/firewall/malware blockers-removers/ cleaners etc - and as updated as poss and checked regularly.

 

However, I will give that other suggestion a go and see if it helps at all. Thank you, dx100uk. :)

Yes I do understand.I too have XP and similarly have more than once asked questions-If I said I found everything easy I would be lying,so I wont.

You have seen the site grow from a few thousand members into getting on for a quarter of a million-the OFT case and stays has hit donations and of course its my understanding that many people who did get refunds simply didnt donate at all.The advertising and the links etc were therefore seen as integral to address a part of the increasing costs of running the site.

 

Once again,I will add that feedback is looked at and its good to get it.You should at least think about some of those things thats been suggested to try and make your CAG visits a more enjoyable experience-and I hope you will report back after trying them.

Can I suggest spending 10 minutes reading this "How do I...?" A Dummies' Guide to this Forum as it will explain, amongst lots of other useful stuff, how to find any threads you have started and any posts you have ever made without having to search all the forums. :)

Obviously not since you are still here.

The washing up remains a big problem Phoenix-the CAG canteen could do with a few new cups.....and I have to say i dont like the washing up liquid that only costs 1.25 for 5 litres off the car boot sale-its not really much good.

I dont want to mention names-but he knows who he is.....

See, it's not pc to say this, but the fact remains that on the whole the male of the species are just not that canny when dealing with such domestic niceties. :cool:

 

It's a fallacy to get dirt cheap stuff like that - it doesn't go as far, or clean as well, and if you're using cheap n nasty, think of what it's doing for your hands. :-o

 

And then there's the tricky issue of whether you're rinsing? If you're not, do it - it's very very unhealthy to be drinking the residues of that stuff, plus all the dregs from other mugs. Bleh! :-|

 

You need rubber gloves for a start.

 

Then you need a good scrubber.

 

Get a better eco-friendly product, use hot water, as hot as you can stand it, and frankly, to put it as bluntly as possible, you need to learn that you don't need to squirt so much.
