I have received a letter on monday from Ruthbridge Limited. I rang them as i can't remember the debt, i can't remember if i paid it off or not. My boyfriend and me have had mortage for the last year and my boyfriend has put a big deposit down on the house. I rang them and the guy i spoke to said they had to track me down and i needed to pay the money he asked for a contact number but i refused. I said i would ring them back. When i did i spoke to a Mr Wilson he said i owed £3228.86 but i had to pay in full he asked if i owned a ahouse and how much it is was worth etc he was being funny with me and said i needed to pay in full and could pay £2583.88. He said i could go bankrupt or get a CCJ or send some one to get goods from my house. He said he would give me untill friday to sort it out or ring him and let him know how i was getting on raising the money. Me and my Boyfriend have been arguing about this i'm not sleeeping or eating i'm worried sick. I was going to go and try to get a loan before i found this web site and i think my story has a common theme with the others. Just wondering if i should follow the advise or can anyone help.

Hi AV your in the wrong forum but Im sure a MOD will move it. as for your problem

 

what is the alledged debt for?

 

dont ring them back ever let them try and ring you, and when they do say everything in writing and put the phone down.

 

everything this guys said is a load of tosh and is against the oft guidelines so your first step is to report him and them to the OFT and Trading Standards

 

depending on what the debt is will decide on what steps we can take to sort these creatures out

Thanks for moving my thread.

The debt is for a credit card i took out in 1997.They said my last payment was feb 2003. To be honest i can't remember if i paid the debt off or what happened to it.

Last payment in Feb 2003 so this alleged debt is now Statute Barred. Ruthless specialise in buying UNENFORCEABLE debt. Send them this letter by recorded delivery.

 

Dear Sir/Madam

 

 

Account reference: XXXX

 

 

Thank you for your letter of the DATE, the contents of which have been noted.

 

You have previously contacted us regarding the account with the above reference number, which you claim is owed by ourselves.

 

We would again point out that under the Limitation Act 1980 Section 5 “an action founded on simple contract shall not be brought after the expiration of six years from the date on which the cause of action accrued.”

 

We would also point out that the OFT say under their Debt Collection Guidance on statute barred debt that “it is unfair to pursue the debt if the debtor has heard nothing from the creditor during the relevant limitation period”.

 

The last payment of this alleged debt was made over six years ago and no further acknowledgement or payment has been made since that time. Unless you can provide evidence of payment or written contact from us in the relevant period under Section 5 of the Limitation Act, we suggest that you are no longer able to take any court action against us to recover the alleged amount claimed.

 

The OFT Debt Collection Guidance states further that “continuing to press for payment after a debtor has stated that they will not be paying a debt because it is statute barred could amount to harassment contrary to section 40 (1) of the Administration of Justice Act 1970”.

 

We await your written confirmation that this matter is now closed and that no further contact will be made concerning the above account after that last letter.

 

We also insist that you supply a full written copy of your complaints procedure..

 

It should also be noted that we will be contacting Trading Standards concerning this matter.

 

Ignoring this letter and continuing to press for payment will not resolve this matter.

 

We will not hesitate to pursue this matter with Trading Standards and the OFT, additionally we will seek immediate legal advice should you continue to press for payment, as we feel this may constitute harassment contrary to section 40 (1) of the Administration of Justice Act 1970, as well as the Protection from Harassment Act 1997.

 

I would appreciate your due diligence in this matter.

 

I look forward to hearing from you in writing.

DO NOT SIGN the letter and do not worry about Ruthless. They are bullies well known on CAG who threaten all sorts of action most of which is illegal. Send the Stat Barred letter and await their pathetic response. We will soon get them out of your life so as you and your bf can enjoy your new home.

Just print your name as it is alleged that some DCAs get creative with Photoshop. Never ever speak to these clowns on the phone. Refuse to answer their security questions. They hate CAG with a passion. The feelings mutual eh Derek;)

Hi, so i sent the Statute Barred letter in the mean time they sent a letter addressed to the Occupier and to call the number urgently, Which i didn't i have now been sent another letter today saying:

 

As we have been unable to contact you by telephone, it is essential you call our office mmediately, in order for us to deal with the issues that you have raised in your correspondence regarding this debt.

Yes, deffo don't even think about phoning them :) Its for them to prove you owe anything, just wait until the write to you again.

Today I recieved a very basic template letter from Ruthbridge Limited, simply addresses to The Occupier asking me to contact them urgently on a freephone number. Hence why I came on the computer to find out who and what the Company are.

I have not contacted them , I had a car from a company back in 2000/2001 and got into difficulty with payments , I informed the company and asked them to collect the car which they never did and I heard no more from them then the company was taken over by WELCOME FINANCE a few months later . I also informed them that the car was available for return due to relationship breakdown and no money available to pay for the car let alone drive it again nothing heard from them.

Until today when i get the letter addressed to The Occupier what should I do ????

Its best to start your own thread, that way you will get your own specific help/advice ;)

In a nutshell...do not ring Ruthbridge, they have no legal powers over you whatsoever - only a county court does.

You must report these shysters to the OFT. Sending a phishing letter like this is a breach of the OFT guidelines. DO NOT ring or write to these people. If they send you something more substantive then do come back and you will get advice on how to deal with them
