CCA and Interest Advice please?

Hi - I have been pointed in this direction by the lovely people on moneysavingexpert. Not sure if anyone will be able to help?

I made a CCA request to a DCA in June last year, they did not comply with my request until Dec 2008 after I had complained to Trading Standards and the Financial Ombudsman.

The DCA sent these documents directly to these two organisations but not to me - in sending them to a third party have they in fact fulfilled their obligations or not?

They are now claiming interest for the whole period, including the six months during which they did not supply to CCA - can they do this?

and they are also claiming interest from the date of default (Dec 2005), this means that they are claiming interest for a period of 18 months before they were even assigned the account - can they do this too?

I am so confused and would really appreciate some advice if anyone can help?

you need to send the dca (who is it by the way) an account in dispute letter. and no I believe they cannot charge interest while the cca request is outstanding

 

It's HFO, they are claiming that the account is not in dispute as they say they have supplied the requested documents. They did not supply them to me though but to a third party so I'm not sure?

The OC placed the default notice in Dec 2005 and the DCA was assigned the account in April 2008 (or August 2007 depending on who you believe - I have been given two stories on this!!).

Thanks - have already submitted a complaint to the FO re this company. Will make sure they know about this latest development and will contact OFT too.

Wanted to be sure of my facts!
