Hi letters of complaint were sent, no replies yet....... When the 33 days from when I filed a defence are up, what happens? Do I wait to hear from the court, or can I do anything pro-active?

Umm, what 33 days.. :confused:

 

The 33 days are those from the issue date on the claim form until you need to put in a defence. From then on it is up to LTSB to take it forward I think.

 

The next stage will be an AQ (allocation questionairre) this will be when a local court will be allocated and you can ask for directions from the court, ie you can ask them to order LTSB to provide docs you dont have, etc. :)

In fact [problem] now have 28 days after receiving a sealed copy of your defence from court, to contact the court and tell them if they wish to proceed, failing that, the claim is stayed.

 

If you hear nothing (the next step, if they proceed, will be for Northampton to issue a "Transfer of Proceedings" to your local court, and you will also get an Allocation Questionaire) you can ring the court and request that they consider enforcing the stay.

Thank you for that. I suppose allowing for the post...ha ha.....if my 28 days are up on the 10th i could rig the court at the week. however, having seen [problem] in action on this site I will probably hear from them before then.

Hi, having finished having a major panic I'm now dealing with the N149.

Am I rght it can be best to leave filing it until the last moment, ie sending SD the day before it is due? Also, should I send a copy to **** using RD on the same time scale?

Hi Cymru,

 

Yes, you can leave it as late as possible.....but please do make sure the Court receives a copy by 4.00 p.m. on the date it must be submitted by.

 

Although you are not obliged to send **** a copy, it is considered good etiquette to do so.

 

My personal experience of **** is that they do NOT send you a copy of their AQ................indeed, they filed their copy to Court 8 days late and got away with it !!

That is what I'm hoping, but I am reading up on the production of microfiche copies and witness statements.

i too have been reading up and finding info on microfiche copys and found out that,

in all likely hood they wont have the true original copy. do they have to provide the

original in court if it was pre 2006?.

 

intersting if they dont....
