Ok try this for tomorrow. The paralegal averred that the first WS was true. Then said the second one was true. How can we be sure what else is true and what isn't. Historically the car park has offered 3 hours parking which is why I stayed there for almost three hours. Obviously Premier if put to strict proof that it was only two hours, all they had to do was to contact Nottingham Planning Department. The Council had already approved 3 hours, so to alter it to two hours would require new planning permission. Unfortunatelt there is no requst showing on th Council planning portal that permission was ever applied to reduce the hours of parking. Not only is that a criminal offence but surely means that the three hour stipulation is still in force. I put it that there case is totally without merit and should be thrown out. As they did not withdraw the case when they realised that the 3 hour notice ruined their case, they should have cancelled it straight away never mind the embarrassment involved to the themselves. As such in the light of them pursuing me erroneously for three years plus adding on an extra unlawful £60, I would respectfully ask exemplary damages in place of the breaching of my GDPR. [Perhaps others could suggest amendments and improvements.] -
Well done on the photos. Keep a list of the signs and when they were put up, because if this does end up in court you can be sure they will lie and say all the signs were there at the start. The government Code of Practice (section 3.4) states - Where there is any material change to any pre-existing terms and conditions that would not be immediately apparent to a driver entering controlled land that is or has been open for public parking, the parking operator must place additional (temporary) notices at the site entrance for a period of not less than 4 months from the date of the change making it clear that new terms and conditions/charges apply, such that regular visitors who might be familiar with the old terms do not inadvertently incur parking charges

no the dca will not have added unfair cancellation fees etc... the Notice of assignment will be the debt value TT sold to them. monthly contractual charges until end of contract term
