Both OH and myself had LTSB credit cards.

 

Somewhile back, after a round robin session with LTSB, Sechiari, Clark & Mitchell (solicitors) and MHA (collection Agents), they finally advised they would no longer be pursuing OH for the amount owed due to the fact that they couldnt find his agreement from 1998. Round 1 to CAG.

This thread deals with my account so Round 2, begins.

 

I sent off the CCA request in February 2008.

 

No response at all received so I decided to give them a little prod at the beginning of April by stopping payment.

 

End of April, I receive a letter advising I must contact them URGENTLY

 

Sent the reminder CCA letter, which was promptly ignored as their next letter again advises I must contact them URGENTLY. They also notice at this time that I do not have a Direct Debit set up. Well no, I wouldnt if I had stopped payments, would I ?

 

May, they are willing to agree to a repayment plan. Wasnt that sweet of them. However, I declined and sent them a further CCA reminder.

 

May, This letter was confusing. They thank me for discussing a repayment plan with them and they are pleased to advise they will accept the £75.00 per month I had offered and that this one time offer would see my interest rates reduced to 0.482% ... What.. !!.

 

My reply went along the lines of, I dont know who you have been discussing the account with, but it wasnt me. Perhaps you would like to provide a copy of the recording you took whilst this discussion was in place. I also repeated my request for a copy of the CCA for which they received and cashed the £1.00 postal order sent in February.

 

Of course, my next letter from LTSB was an acknowledgement of my Complaint !

 

June, they have noticed I have not made the payments they agreed with me in May ? I just filed the letter, they had obviously lost the plot and I really couldnt be bothered.

 

September, Another letter demanding I contact them URGENTLY - Ignored

 

2 days later, **** are apparently instructed by LTSB. That despite several reminders, including the issue of a Default Notice served pursuant to Section 87(1) of the Consumer Credit Act 1974, myaccount still remained out of order ? :D Umm, nope, I have not received a Default Notice so **** or their client are fibbing.

 

Letter to them, reminding them that despite several reminders to their client, I still had not received a copy of the CCA and they too were in Default of my request. I copied the letter to LTSB.

 

No response from ****, but LTSB did write saying they had previously agreed a repayment plan with me . They were concerned I was not sticking to that plan. Letter filed under "I"

 

October, **** had advised me in September that a Default Notice had been issued. So it was a bit confusing to receive a Default Notice dated October from LTSB. It was dated 2nd, I received it on the 7th and I had until the 20th October to remedy. Still no CCA, so filed under "I"

 

End of October, Formal demand from **** for repayment. - Filed under "I"

 

December, BLS are invited to join our little penpal group. They say, unless I contact them URGENTLY on a premium rate telephone number then they may just be forced to phone me :p They may even advise LTSB to consider a personal visit. My response advised that until LTSB provided the CCA, requested, I would enter into no further discussion regarding the account.

 

BLS then sent me a letter offering me the opportunity to reduce the amount owed to LTSB by exactly the amount they had shoved on in charges . - FIle - "I". I considered at this stage investing in a larger file

 

January, BLS, advise they have written to me recently, I have ignored their letters and they are now considering advising LTSB that a personal visit will be required. - File "I", larger file purchased.

 

Following week, I knew the larger file was a good investment. BLS again, Contact them URGENTLY .

 

February 2009, BLS write again. Different tone this time, They understand that I may not be in a position to pay the full balance. If I make contact the author, squiggle, might be able to show the appropriate flexibility ? :confused:

 

Following week, Now BLS are getting heavy. As it would appear I am not going to pay the account on a voluntary basis they are going to bring in the heavy mob. I am forcing them to apply for a Warrant of Execution, at Attachment of Earnings and or a Charging Order.

 

Aha, a letter of Impending legal action. I can get my teeth into this one.

Short and sweet response. I acknowledged we were now at an impasse. I commended the genuine attempt to resolve the situation by putting their case before a Judge in order to resolve the situation once and for all.

 

March, Oh dear, BLS dont want to play anymore. **** advise that unless I repay the whole amount outstanding within 7 days, then they have no choice but to commence legal proceedings.

 

I copied all the previous letters **** had written, basically advising the same thing and included a similar letter that I had sent to BLS.

 

Immediate turn round on the reply, **** advise they have ordered a copy of the application from LTSB.

Maybe you ask them to doctor what they sent a little more as they have used the wrong a/c number and you are not sure if it's for a platinum or a gold card. Maybe they'll get it right next time or maybe the time after. Give them every chance to get it right, then the noose is tight, so tight they'll foxtrot tango.

Keep throwing them the bait, you/we all know that they are "out of control" and that they very rarely communicate with each other, every dept/employee, seems to adopt a differing tactic from the other when dealing with our requests, no matter what it is.

 

They seem to be dealing you a good hand at the moment and you obviously know how to play it.:D As has been previously stated in other threads these people are out of control and need to be accountable for their dubious tactics/actions.

 

As twofoot has posted the noose is so tight they"ll foxtrot tango, with your tenacity I hope they will "FOXTROT OSCAR" :D;)

I received a letter from LTSB yesterday advising they were dealing with the complaint I had lodged with them 4 weeks ago:confused: That despite their best efforts they have not been able resolve my query?

 

The last time I wrote to LTSB was in September 2008 and yes it was a Formal complaint. In that letter, I pointed out that they were in default of a CCA request, arrogant in their continued ignoring of letters and gave the 14 days to respond. Obviously they have no real concept of time.:D

Hi CB,

 

Just to let you know I have subbed to this thread.

 

I`ve just had a quick read through, and although it`s late, are you saying you have been Defaulted for the wrong account? Or, the account is not your`s?

 

If the account is not your`s then play along with it and don`t tell them their mistake. If they take you to Court they will look REALLY silly.

 

I`ll have another, slower read through tomorrow when I get in from work.

 

Don`t you just love the numbness of LTSB?

(subbing, here's my brief)

 

I thought I was reading about my saga when I first started reading this thread! Very similar except that SC&M are taking me to court, they started in early January 09. I have in the last few days submitted my allocation questionaire.

They failed to respond to my defence in time and according to Northampton they paid to have the stay lifted? because of the backlog at northampton my request to have it struck out, although arrived before they paid was not looked at untill after this?

They have refussed to supply any paperwork

They sent me paperwork imploying that judgement had already been awarded and here is how to pay.

I am expecting an allocation hearing and then to recieve the paperwork just before the actuall hearing.

 

27 bil give them rights to do what they want!:confused:

I don’t think LTSB do a Gold card anymore so they probably just changed your card to a Platinum version – In the latest version of their t&c’s (at 15) they say they can change your card type at any time blah blah.

 

Not sure how long they had this term in the more complete version of the t&c’s but if it wasn’t in the version when you signed your application then you have to question if they have a right to change your product type without getting you to sign a new agreement – strictly speaking they are modifying your agreement with your permission.

 

In the UTCCR 1999 an example of an unfair term (which will have the affect of voiding the term) is –

 

(k) enabling the seller or supplier to alter unilaterally without a valid reason any characteristics of the product or service to be provided;

 

I will be arguing this out with them in court soon – although in my case they changed from a Visa to a Mastercard and this is definetly a change in product type because there are certain places you can use Visa and not Mastercard and vice versa.

Not to mention Section 18 Multiple Agreement, you are therefore Restricted to using the Card only where they accept Mastercard, but you can also withdraw Cash and use it Unrestricted anywhere. Not to forget, the interest is higher when making Cash withdrawls. Is that on your Agreement?

Aha, thanks for that atwozee. The terms and conditions shown earlier are the only ones I have received from them. There is nothing that says they will or can change the type of card.

I have a similar story to you CitizenB, even down to the alleged agreement to pay them back in installments which I never agreed to.

They've sent me a copy of the application form and I've just been offered a 50% reduction ay AIC on the alleged debt with the promise that will clear it in full.

 

Do drop by, any advice gratefully received.

Will keep an eye on your progress. :-)
