    • It is important that you do the reading about this subject in the sub- forum. It's not complicated but you need to be in control and I don't think you are. For instance, much of the information you need and also the case transcripts that you're looking for are in the fixed topics at the top of this sub- forum but clearly you didn't know that. You will gain in confidence if you do the reading. Particularly as it now looks as if the mediation has not worked because EVRi have stayed you up and so you may now be going to trial. You need to understand thoroughly what you are doing. We will help you and you will find our support is unstinting but you have to do your part. Please spend a lot of time reading the stories on the sub- forum especially the pinned posts at the top of the sub- forum and then start preparing your court bundle. We have instructions here for everything
    • I have had a secondary thought.  I borrowed £s from a completely separate entity 6y ago. It was personal and unsecured. I was going to repay upon sale of the property. But then repo and I couldn't.  Eventually they applied and got a charging order on the property.  Their lawyers wrote that if I didn't repay they may apply for an order for sale.  I'm not in control of the sale.  The lender won't agree to an order for sale.  The judge won't expedite it/ extract from trial.  Someone here on cag may or may not suggest I can apply for an order v the receiver?  But could I alternatively ask this separate entity with a c.o to carry out their threat and actually make an application to court for an order for sale v the receiver instead?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Since having my crap one credit card back in 2005, I have had around £50 of PPI charges added to my account.

 

I have been told that I should try and claim these back as they are asking for £300 balance to be paid and this is made up of total charges, and in fact they owe me money!

 

How would I go about claiming back the PPI? Is there a letter template to use that I could send please?

You could try this for starters.

 

Full SAR for ppi

 

The fee is £10.00 but ask for every little bit of data. You should perhaps look here first to decide if you have a case for capone mis-selling (nearly everyone does have a case) but please read first.

Halifax - Full settlement incl interest.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

 

PPI Claims ongoing with:

Cap one Now with the FOS

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.

LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

 

1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

claimed 1600 from capital one,hey said no chance..

Told them I would take them to court o they offered 860

Turned it down but they did not improve offer.

Accepted the 800 to pay for my holiday

 

That's great news, I haven't heard anything back yet with regards to an offer, but they seem so take weeks to reply to any letter.

 

If I got that I would be well chuffed. Seems they offered you half of what you are clamining, I wonder if they will do that with me!

I have just had an offer of £330 from them which like you is just under half of what i'm claiming, sent them a rejection of offer letter, just waiting to hear back.

My PPI amount was small aswell £50 odd pounds, today after just one letter from me they have offered me all of my PPI back but only a flat 8% interest on top. Im not sure what to do they saying they are going to credit the refund to my account, not sure if I can go after CI interest alone.

I have today received a letter refunding the FULL PPI of £51.17 plus associated interest of £4.09 - this has already been refunded apparently - still lives a £300 + balance though of charges! :evil:

 

A success even though small is still a success but I would make sure you check the statments to see the refund has been credited to your account:eek:

 

Check everything but it is money back to you which is good:D

Just got second offer, double what they offered first time! :)

 

All i need now is for them to pay it straight to me and not take it off my outstanding balance! :(

I had my FULL PPI refunded at the first request (apparently) but have yet to receive another of their chaser letters telling me the current balance!

 

I am now in the process of claiming back my charges, out of the £900 they owe me they offered £138! I have since gone onto www.moneysavingexpert.com and used their calculator to claim interest and it amounts to well over £1,000 so I will be putting a letter together today to get that sorted out.

 

They tend to put the money onto the account but they "should" send you the remainder via cheque. I cant imagine they will just refund you direct if you still owe them money though :(

 

Was your claim for unlawful charges or for PPI?

In fact think i may start my own claim for the charges on the account too. Been too busy concentrating on my ppi claims forgot i could still claim charges on credit cards! :)

 

All helps towards getting the balance down!

How much of your debt is charges?

 

I have worked out that my charges since 2005 are £856 plus statutory interest takes it to just over a grand - its worth it!

Not sure, not got all of my statements, gonna send off SAR today.

 

Managed to gestimate with ppi.

Have just registered online at the MCOL so I can process the claim after the 14 days when they received the letter, hopefully it won't come to this though

If any of you are successful in getting the PPI then PLEASE PLEASE check that its been refunded.

 

I have telephoned them today and they offered the refund on 3rd April and its hasnt been done! Apparently, it will show close of business tomorrow so will be ringing back and checking that as well!

I'm having the same problems with Cap 1

Told they had refunded my account but the next day they "sold" the account to another company. The balance they sold didn't include any refund.

I've been chasing this for nearly a month now.

Anybody any ideas what to do as I could really do with the money in my hand and not theirs.

Luckily we record our calls at work so I have that as evidence, I will ring them tomorrow to ensure its been put on.

 

So far though I have been lucky in that any refunds have been amended onto the DCA
