      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

You would be better off emailing them as they never answer their phone. Just to let everyone know, I complained about this company last year and a few weeks ago after not receiving a reply and the 8 weeks time limit they are allowed to reply within being up, I again emailed James Keeble himself. His reply was not acceptable and I asked him that as he had had my money (£178) for 27 days, which they shouldn't have taken, did they feel compensation was in order. I also advised I would be contacting Office of Fair Trading about this company. Lo and behalf, he replied by return on email offering me a compensation payment of £56 if matter was resolved there and then.

Can anyone give me the phone number for CFO, i have tried looking for it and cannot find it anywhere?

 

I have had bad dealings with there, but it would take me a week to outline the issues lol

They have taken £100 out of my account today, which has put me overdrawn and will occur bank charges. I need their number asap. I havent got time to write them a letter incase they take more out.

It's not their phone number you require - get onto your bank right now and get it reversed and stop any further automatic payments. It's your bank account, you pay them.

it took me nearly two months to get my money reimbursed - but I didn't give up and even got extra payment for the time they held my money - £54. Your best bet, I think, is email - James Keeble direct is

[email protected] - tell them you will report them to Trading Standard Office if they do not contact you - Good Luck

As we are sure you know, at CFO we are more than aware of the comments posted on this forum about the service we provide and individual cases.

We would like to emphasise that we do not and have never purposely taken any payment from an individual who did not have an outstanding agreement/balance with us. If you choose not to make repayment on time late fees will be added and collection procedures will commence. We are upfront and honest with regards to our late fees, which are all documented in the credit agreements signed by our customers. We have many customers who use our service correctly, (i.e. to cover an unexpected bill or car repairs) make the repayment on time and are then able to borrow from us again at any point in the future should they need us.

 

With this in mind, if you feel that you are unable to make the repayment, please do not take out the credit. If you do not adhere to the rules of the contract terms and condition will apply.

That's not true - you took money out of my account when the loan had been repaid and I didn't owe CFO anything. To be fair we did come to an agreement, however, it took 8-10 weeks to get money back you had taken from my account AFTER the loan had been repaid - it was my determination to get compensation for the way I was treated and not the customer service of CFO

I cannot believe the rubbish that I've just read that was spouted out of CFO rep's mouth or should I say keyboard. This company is laughable - they prey on people who are in dire straits financially and then clean them out often without the permission of the debtor! :mad: Any company that omits their telephone number off their website obviously cherry pick which emails they answer and which they just delete. With phonecalls they might have to sound like they know what they are doing! :p

 

As you can tell I have had a run in with this company and they are worse than useless for customer service. Avoid at all costs.......................

It saddens me that that a company that apparently have so many clients to service can allow their staff to spend time on this website (guilty conscious maybe) , though I'm sure there are a zillions phonecalls to answer now..............:rolleyes:

we have had nothing but hassle with CFO. we had a payday loan last july, and my husband lost his job shortly after, so we contacted them and they arranged to extend it by 2 months but each month they still took £75 in interest each month and on the 3rd month we offered to pay £50 each month till it was cleared, they accepted this, but at the end of month 3 they took another £75 instead, and on month 4 totalling £300 which was the cost of the original loan. We tried to contact them, as we have 5 kids and where my husband had no job still and we were on benefits. They did not reply to e-mails of phone calls, and we heard nothing for a few months, we got hold of them last month eventually, and they agreed to £10 a month till rich starts a new job, but Lo and behold we checked the bank this morning and instead of the £10 agreed they have TAKEN 4 DEBIT CARD PAYMENTS CLEARING OUT OUR ACCOUNT

one for £10 one for £20 one for £10 and onf for £75 totalling £115, got em on the phone this morning at long last, said there is nothing they can do, was really snotty and put the phone down, but he said they have no record of any agreement or previous payments. AND STILL SAID WE OWE £240!!!!!!!!!!!!!!!!!!!!!

The original loan was only £250 and so far they have taken £415 and reckon we still owe £240!

have sancelled the card natwest assure me they cannot take any more, but any advice anyone????????

As I posted couple of days ago, company did same to me and took money even though I had repaid loan. Fed up with dealing with them I contacted Office of Fair Trading (no on net) and wrote letter of complaint to CFO. After 8 weeks (time limit they have to reply) I had heard nothing. Emailed them and got answer directly from James Keeble apologising - I said this wasn't good enough and wasn't prepared to accept this and would take matter further as, after all, they had had MY money for nearly a month and I felt some compensation deserved - he emailed back straight away offering compensation payment and that would be end of matter. I agreed. You have to be determined to take this matter further.

Cheers 4 that, i have tried the Financial ombudsman, but they lines say there is a tech fault, please call back later! have contacted my local citizens advice, and they said in no way can they take mon ey that is not authorised, it is theft, i have an appointment tomorrow, am going to take my bank statements in to them, and print the one from today, they have made the appointment, and said they are going to contact them on our behalf and will take up the case to get our money back.

I set up an arrangement to pay back my debt by installments with this company when my hours were cut at work and I was unable to pay back my loan with them in full. In spite of me adhering to the plan, they managed to take £20 from my account using a debit card I HAD CANCELLED!!.

Im due to have money paid into my account tomorrow (a hardship grant from my University - I'm a postgrad student) and I dont want it to get swallowed up by CFO.

 

How can they take money from me from a cancelled card? I have called my bank and they said that sometimes cancelling the card does not guarantee that it cannot be used again - what a pile of.....

 

Any advice will be greatfully received guys

Just spoke to my bank who said that they can still take money out of my account from the cancelled card if it is a subscription / regular payment even though the card has been stopped or cancelled!

 

so basically they are going to rob me of every penny that ever comes into this account?!

 

What can I even do!

I recently had 2 transactions on my bank account with the reference of Capital Finance One. I was unaware of what these charges related 2 and reported the payments to my bank as unauthorised. The bank placed a pause on these transactions, I guess while they investigated them, and I waited for them 2 get back 2 me.

 

A week ago Capital Finance One contacted me stating that a loan that I had taken out in June had not been repaid. I had totaly forgotton about this and was unaware that the payment hadnt been made. I now remember that I had taken out a loan, and have checked, the money is on my bank statement in June.

 

They said that as I had the transactions stopped that further action would now be taken to retrieve the funds. They said that I am not even allowed to make the payment to them again!

 

Today I received a letter from a solicitor advising that Capital Finance One is proceeding with court action to reclaim the £512.50 that I owe. It explains that I will be “liable for the fees of the court” wich makes the total amount £737.50!

 

Can they do this??

I would reply to the solicitors offering to pay loan plus one months interest if you can afford it in one go. Point out that it was CFO's fault for not taking payment when they should have done. If not I would offer them a repayment plan that you are happy with. Doubt very much they will risk going to court. Get that card cancelled as they will try again.

I have a missed payment and now am getting the usual "i can do you a deal" and leave some of the interest off. TBH i cannot really remember how much i borrowed or how many times i rolLed over its gone on that long.

 

should i write out a final offer letter to clear the debt?

One rude primitive called Jason from CFO always called me from private number, but last time he probably make mistake or whatever and I saw this no on my cell.

I had a loan with this outfit and I lost my debit card. Obviously cancelling it and had a new one issued. They managed to take the money on my NEW debit card even though I had not given them the details!! I checked with the bank who confirmed that it was the new debit card and they have taken it up as fraudulent activity and have refunded the money to me. I am awaiting the outcome of their investigations.

I noticed alot of people are saying about problems paying the loan back and having payments taken out. Yesterday me and my partner both applied for a loan with this company and both was accepted we both were told it would be in our accoount by the end of yesterday. The money is not in either account one of us is with halifax and the other with natwest. Has anyone else had problems with the payment times. How long does it normally take to get in the account.
