Hello,

 

I started this claim a long time ago and did everything bar going to the courts. Mainly due to all claims being stayed etc

 

But I am in extreme financial difficulty and was told the bank have to deal with your claim now if financial hardship can be proved, if they fail to deal with it the OFT will make the decision.

 

I would be grateful if someone could please clarify this for me.

Hiya ozydogy and welcome to the HSBC forum:)

 

The terms of the FSA waiver allowing banks to do nothing with claims while the test case is in progress were amended to exclude cases of hardship and make them look at these claims however we have found that the banks refuse to recognise hardship.

This leads to people referring the bank to the FOS who are snowed under (last I heard about 8 weeks before they will look at a complaint).

 

So the mechanism is there but its not a quick process :(
