Hi,

 

I took out a loan from Welcome in Jan 2006 for £15000 as per the agreement below. It had PPI on it. We took a further advance from them in March 2008 which meant paying off the below agreement. While they didn't show me how they calulated the redemption figure I know that it was over £19,000.00 that we had to pay back. Can someone please have a look at the agreement below and see if they think that the redemption figure might be incorrect? Also, to advise if there is anything in this agreement that makes it unenforceable?

it 'looks' ok and i say looks because Welcome have a habit of making their agreements look fine but dig a little deeper and you find the can of worms to open - have you SAR'd them? - that could be where you find anything if there is something to find?

I can't actually remember. Is there any way that I can find this out?

 

 

Ok you def need to SAR now - if the gave you a copy prior to you visitng to sign or what have you they should have logged as such on your account.

 

This would be the easiest way out if you can prove you didn't have it as it's spelt out in clear letters on their own paperwork

-Full copies of all contracts which you believe exist or have existed between myself and your organization, including true copies of any documents you hold in support of the same.

 

- A complete list of all transactions or statements relating to ALL of my Loan Accounts and or credit card with your organization.

 

-Copies of all documents which include any of my personal information including copies of any contacts or invoices, emails or computer records containing my personal information, or any records which pertain to this information.

 

-Full copies or transcripts of any correspondence in postal, email or any other format which you have entered into with any individual, organization or third party which contains my personal or financial, or which pertains to me.

 

- Where any previous information or records held have been deleted or disposed of, the methods used to do so, including dates, certificates or references confirming details of destruction. Where you are unable to provide such certificates, please provide a declaration, signed by an authorised officer of your company, confirming the dates and methods of destruction of this data.

 

-Full hard copy print outs of my personal or financial information, held in a digital, magnetic or any other format which is held in any archives, backups or other storage devices / locations.

 

I enclose a cheque in the sum of £10 to cover your fee.

Always print your name - never sign - enclose a £10 postal order and write on the back for use to process SAR only and not to be credited to your account - they have 40 days to respond - if they're in business that long!!

If I have taken out a subsequent loan with them to pay off the one on the above agreement does this mean that I wouldn't be able to challenge the agreement above?

Also, would I be right in thinking that the same statement would be on their agreements now (the one saying that you should receive a copy 7 days before hand). The reason that I ask is that the loan that we took out in 2008 we were not given a copy 7 days before hand. I went in to see them and went through the application and told we had to come back together in 7 days to sign. I was given nothing away with me to enable us to read terms and conditions before signing and when went back in were just told where to sign.
