      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I know i shouldnt have but i rang them! had a lovely arguement as they wont repond to my emails. confirmed the addresss and they say they havent received the 4 emails i've sent. They did confirm that they are part of MEM and will be forwarding my to 1st debt collection or something like that! not will willing to accept any repayment etc as my income is too low and wont put anything in writing unless i wish to pay for a transcript of the call. I said i'd contact the finical obusman and he said... well your not allowed! I'd love to swear but i dont think the webmasters would approve lol.

 

I said "what should i do if you wont accept my payment" and they said "Dont know!"

 

Any futher advice.

 

PS they say it wont go to clarity! mayb they have parted ways?

Hi Lozzy

 

I would just sit back and wait for them to contact you. Not a lot they can do really other than pass to DCA of their choice. Ultimately you have made an offer that they won't accept. From what I have seen so far DCA's are generally easier to negotiate with than the companies themselves. Let us know when you hear from them.

In a final attempt to cover my ass, i have once again emailed Payday uk & Keyes Whitlock & Company. In a suprising turn around (orginall they said they would not accept a repayment of £50 or £30 a month they have offered me a payment of £52.50. To save myself some headache of debt collectors and to clear the balance quicker i am going to accept however, do anyone have any suggestions on basicly what to reply.

 

What i want to do is prior to offically agreeing to anything to have an agree set of conditions i.e they will stop interest and not pursue me for further amounts after repaying the agree amount etc. anyone know of any others to include?

What does everyone think?

 

Dear Sirs,

Before I officially agree to this repayment I wish for you to confirm a few items for me please.

Can you please supply me with the current balance and confirm that once this agreement is in place no further charges or interest will be applied to the account to enable me to clear the balance.

I also wish for confirmation that once the agreed current balance has been repaid, that you will not pursue me for any additional costs or hold any comments on records held about me after the repayment of the outstanding balance which would be consider as defamation.

Hi Lozzy

 

Look OK to me. A good idea to get something in writing from them as they will tell you anything. I would be tempted to add a payment schedule and ask them to confirm they consider this arrangement as FULL AND FINAL SETTLEMENT. Either way unlikely they will hound you if you maintain payments.

 

At least they are now listening to you!!

Hi Lozzy

 

Looks good. Do you really want them to have your card details. I would ask for their bank account detais to make manual payments or set up a standing order.

 

They may well take whay you have agreed but can you afford for them to take the lot (they have been known to) and then for you to have to chase them for it?

Well i've given them a chance with my card details and today they only took the payment for £52 as agreed! fingers crossed it stays this way!

Well done Lozzzy, just sent my Right of Appropriatation letter to First Direct and now have to contact PadayUK (MEM) to say they won't be paid. Owe them £675 and feel bit better after reading your thread.

Cheers, they replied to email of my offer of £40 saying they had to take payment this month, I replied and said I had told bank not to pay it, ask me to ring them but I said wanted everything in writing

The fun has begun.

 

I sent letter with details of payments I wished to make etc and asked can everything be carried out via letter and email with no phone calls so I have a copy.

 

Have rang me twice (I didn't answer). I have mailed twice saying don't ring me again I have made arrangments with bank to cancel the payment, they have replied saying payment will be made this month then we can talk about increasing my loan amount :confused:

Had 2 calls this morning (one to mobile and one to work) which I didn't answer and a text message to ring them immediately.

 

So much for the emails saying please don't ring.

keep on at them. Out of interest, does anyone know if they can actually contact your place of work.

 

Oasis aka 1monthloan have a claus in the contract that they can contact your boss and ask for money to be taken from your wage.

A friend of mine has managed to get them to accept minimal payments with interest frozen. This was after being told they were entering in to a DMP. Prior to this they continually tried to 'reset/defer' the loan

 

It would appear this company are keen to keep you in debt with them. I would write making them an offer you can afford and don't be pushed in to deferring etc. They seem to be more reasonable when they realise that you aint going to budge.

 

My friend also has their bank details and is paying by standing order.

i had a £750 loan with MEM (PDUK) that with interest meant I owed them £935. Defaulted due to short month & while they harassed me for a while & handed me over to Keyes Whitlock (same address) & threatened doorstep collection. I sent them an offer to pay in six equal instalments via email over 6 weeks ago and never heard back. No adverse info with CRA either!:p

that sounds great, but be careful. i emailed Keyes and whitlock and they just ignored me and evenually after several weeks they started to send letter after letter whilst still ignoring me! in the end i emailed them and copied in payday uk and harrased them until someone finally replied and set up the repayment plan. I hope they have forgotton about it but please dont think you've got away with it cause at some point the chances are they will track you down!

if you need to stop this company taking more money than you want them too...

 

get a new card for the account they already know about, then they cannot take the money, they do it through a debit transaction, and the security code is different on the new card..

 

search on here for a "pay as you go credit card", 02 do one for their customers for free, and other companys do free ones, search this site and someone will point you to a free one.

 

load the card with just the right amount of money each month, and give them the details for that card...

 

im doing this now, for this company, as they have told me on a few occasions "if we try for the full amount, and it goes through, there wont be a refund, it will be taken as settlement"

 

so to eliminate the risk of them taking more than I want them to... i did the above...

 

 

i dont use this forum much so feel free to copy and paste this tip anywhere it may be of use... its easy and free and works

My £685 debt has now been handed to a debt collection company from Glasgow called Buchanan Clark and Wells

 

I did offer Payday UK £40 a month 6 months ago and they wouldn't accept it. All rest of my creditors accepted it and have one more payment with Barclaycard and paid a few payments to First Direct and Visa

 

Have just written to the debt collection agency trying to set up repayment plan
