    • receiving a default NOTICE (forget simple default cal markers) does not mean it will get sold on... OC's very very rarely do court themselves.  if it does you would receive a Notice of Assignment from the debt buyer/DCA.  as for reduced payment if it remains with the OC and they issue a DN, no harm in trying but lets get all your ducks inline first. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hey all,

 

I have got some payday loans which are getting bloody expensive! I cant contiune with them and still be able to pay my mortgage and therefore i am thinking of ways to pay them off ect.

 

I just wondered basiclly what methods everyone used and how you rate it (short term or long term & any effects on your credit rating etc!).

 

I've seen that some people went to the companies and said they couldnt pay, but i've seen adverts for conslidation over 6mnths which might not mess up my credit rating much more (its already rather unhealthy but will end up costing my just as much!).

 

My loans are with Payday UK, 1month loan (oasis), and Wageday Advance ltd.

 

Has anyone else used these companys and paid them off and lived to tell the tale?

 

Any inform or background would be appricated so i can start planning my attack!

ime a reformed pay day addict

they way i did it, which they did not like at first was to get them to put a hold on the account.

i made a reasnable offer of fifty quid per month to clear the accounts

they threatened court at first, but they are scared of trying to explain the interest rate.

 

try the letter approach or email first

they might surprise you

quite a lot of pay day loans get defaulted so this way, they will get there money

 

its very rar for a payday loan company to put a default on your credit file

I loosly understand that if i go to the finical obusman (excuse my spelling) they have a system for making companies agree a repayment plan etc etc. has anyone considered this? apparently the FO can insist on them accepting a payment (what ever is agreed). does anyone know if this is true, as if they can be forced by the FO it could save people some heartache and hassle of trying to get these companies to agree.

ps. postggj would you mind mentioning which companies you owed. I've read that some people have been having a few issues getting payday uk (MEM) to agree to anything (like trying to nail slime).

your account with payday uk will be passed to a company ,dca, called clarity

these are no problem to deal with

 

a lot of these payday comanies are basedin malta, you get bombarded with calls from canada and southern ireland, out of uk duristiction

 

most of the agreements are crap and fall foul of the cca

 

stand your ground and offer a decent repayment proposal, they will except in the end

 

change your debit card number and cancel any dd or they will empty your account

i'm just doing formation of contract and CCA at college so hopefully i'll understanding it all one day soon if anyone else is reading this in a few months time, i might be of some use!

 

In the meantime, i hope you dont all mind but i'll continue to make note of my progress incase it helps anyone else!

I used CAB who sent letters of repayment offers to all my Payday jaunts (4 in all!!) they accepted reduced payments to clear of debts aprt from PaydayUK who passed my account to Clarity who also accepted minimum payments?

hi i tried to look on the CAB incase they had some template letters i could use but i cant find any (and appointments are like gold dust!).

Your offer of £65 per month is VERY generous!

 

My balance with these clowns was at £1230 including some crappy fee that I had removed, and they accepted £30 a month, but I waited for them to hand me over to Clarity first. They are a bunch of softies as far as DCA's are concerned.

They are not bad at all. I sent them a letter stating they should not call me or any visits. And they kept to it.

Everything in writting!

 

I paid £30 a month for a while then after a short while I offered a MUCH reduced offer that was accepted and cleared the balance. No record of them was placed on my credit file at all.

 

Just stick to the agreed amount. And if you can after a few months make an offer of about 60% of the remaining balance.

 

Ive only got one left to go!! :D

I have 4 loans at the moment, total interest only payments are about £575 permonth, effectively this would mean that I could afford to pay one off each month for the next 4 months however it does not work like that.

 

QuickQuid are happyto take a partial capital repayment along with the interest for rolling over however PoundsTillPayday want the whole aount each month before re-lending. Therefore the procedure is slightly different with each lender.

 

I am looking to put a proposal to each of them of £100 per month until paid off and was wondering what the best course of action is.

 

I am assuming that the first thing to do would be to cancel my Debit Card, which funds 2 of the loans and cancel the DDs for the other 2.

 

Does anyone have any template letters for them, they are (in no particular order) PoundsTillPayday, Quick Quid, Uncle Buck, Early Pay Day Lenders.

 

(To be fair the last two are not two bad. Uncle Buck refunded a £75 charge incurred because they took payment on the wrong day...)

 

It is just that £5k in interest over a year is a little steep for £2k worth of loans!

i sent them a letter saying that i couldnt pay and giving them a breakdown of what i pay out etc thus saying i have £x which i can pay, please stop the interest and charges. they have refused my reduced payment over email and have wrote to me demanding payment therefore i am going to stop emailing and send everything recorded delivery!

I would hope that after all these letters that if the issue does go to court you can at least prove you tried to negotiate but MEM refused, that way they could be nailed...

 

As far as 'contacting your employer' goes they cannot do anything other than telephone, and should they tell your employer anything that is a breach of confidentiality. They cannot get bank details and 'arrest your wages' WITHOUT a court order, hopefully most payroll people know this and won't turn any information over to them. They are working on the 'fear' factor here.

I've emailed this company but they keep ignoring me which makes me nervous!
