I am pretty sure that every person is now entitled to 28 paid holidays per year if you work full time......

 

My company has decided that I am only entitled to 26 days per year.....I work full time??? Am kind of confused by this as I was sure I would have 28 per year. I work shift patterns (7 on 3 off, 7 on 4 off) but surely this should not affect the 28 days???

 

Can my company do this?:confused:

Link doesn't work. I did do that earlier and it gave me 331 hours per year.....guess my company can only give me 26 days as long as I get the right hours. Oh well. Thanks though Ell :)

Thanks - they are working on the 5.6 weeks per year rather than the 28 days per year. Thing is, peeps on different shifts get the full 28 days.....hmmmm.

well, at the moment its only 4.8 weeks (equivalent to 28 days plus bank holidays), AFTER 01/04/09 you will be entitled to 5.6 weeks (equivalent to about 40 days inc bank holidays).

 

it might be worth having words there.

Hmmmm - think I will. They have sent me a letter saying from 01/04/09 am only entitled to 26 days. I do not have every bank holiday off - if I'm rostered to work then I do. So, from what you are saying, I should be entitled to the full 28......will be having strong words with these cowboys :mad: I thought this was why this ruling was brought in :mad: Am so annoyed!!!

 

They use the reckoning that on an average of 56 hours per week, my entitlement works out to 26 days per year based on the 5.6 weeks per year. Think they are pulling a fast one. Will phone them on Monday and get to the bottom of this.

Right, I am going to send this email to my Operational Manager - feel free to change if necessary:

 

Dear xxxxx

 

I received my payslip today, which also included a letter about the holiday entitlement. I would like to know how (employer) have worked out - in detail - that the Security Officers at (my place of work) are only entitled to only 26 days per year, instead of the 28 as laid down in government guidelines. The 28 days was passed to ensure that those who DO NOT work bank holidays do not have holidays taken from them. As I will work the occasional bank holiday, this does not affect my entitlement to 28 per year. Or, am I to presume that I can take paid leave on Bank Holidays and still have my 26 days? (which would be the case if I worked in a Monday-Friday environment).

 

Government guidelines are clear. Even though 5.6 weeks per year is mentioned, this does not affect me as I am not forced to take Bank Holidays as part of my holidays. Based on an average of 56 hours per week (and I have sought advice), I am entitled to 28 days PAID holiday, per year.

 

Please can I have a copy of the guidelines which (my employer) appear to be following on this matter. I am really quite annoyed that my legal ENTITLEMENT is being taken away, as will all others based at (my place of work). It is also unfair that those working a different shift pattern DO get the full 28 days (as shown in the letter I received).

yeah, that letter looks fine, just as a double check though, click HERE to calculate your full entitlement.

 

make sure oyu state this is the amount you are entitled to in your letter and state that if you do not recieve written confirmation that you will recieve your full entitlement you will lodge a formal grievance etc.

Yeah, checked that and it comes back as 26 days per year.......I think they have got me on this one. Thanks though. Will not send the email as it's not relevant. I was just under the assumption that everyone had 28 days per year.....oh well.
