    • Hello, Following the submission of my defense, last night I received an email from DCBL indicating that the claimant intends to proceed with the claim (I've attached a screenshot of the email for reference) along with the N180 directions questionnaire. I'm unsure how they obtained my email, but I suspect it was through the courts' form when I completed the Acknowledgment of Service. This email almost slipped my attention. I have also today received a letter from court to state they have received my defense.  It appears they are requesting an online telephone hearing with the court.     • Default Amount £9237.88, all this started in 2006 Admitted debt £9075.65 Weightmans added £1515.01 immediately they became involved, no explanation The Statement shows when Marlin bought debt in May 2011 £10439.25 Their statements, not received until the SAR, are based on this. Cabot deducted £1515.01on their statements in January 2019, again did not find this out until SAR. Weightmans added in  2007 after the CH1 etc was confirmed by the court £741.50, made up of Process server fees, Court Fee (they tried for bankruptcy), Solicitors fee and Land Registry fee. Unspecfied Legal costs were added by Marlin in March 2015, again I did not know this until statements received with SAR I had been paying monthly, without exception until December 2018. I am minded to take the property charge, CH1 amount ,deduct all my payments and the subsequent fees, and request/demand a refund on the final payment made? I consistently disputed Weightmans balances, but they never responded. I also told Mortimer Clarke/Cabot that I disputed their amounts.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi guys, just stating out with a £3,400 claim. Previous threads make for interesting and uplifting reading! We got hit with £490 charges in ONE MONTH alone! They sent through my duplicate stats PDQ, and I've drawn up my spread sheet and written my letter which are getting posted tomorrow. Wish me luck! Any and all advice warmly welcomed! :)

You are doing exactly the right thing, Nationwide are a doddle at the moment and follow everything to plan, every time. Loads of us have had our charges back and you'll be no exception. Any help you need, just ask....you'll get bog standard 'our charges are fair and transparent' letters along with those asking you to wait while they investigate....ignore them and stick to YOUR timetable and you'll get your money back within 6 or 7 weeks :)

 

Oh, make sure you have another account as they WILL close yours.

Many thanks for the words of support and wisdom. Nationwide have been the least sympathetic and most unhelpful organisation EVER, and it would make me smile for a month to get one over them for a change. Will most def keep you posted. Thanks again.

Hi there... We've opened up another account now, but what happens with the Nationwide account? It seems that previous Nationwide claimants have had monies paid into their Nationwide accounts... but if the account has been closed how does this work? Also, we're using about £500 of a £2k overdraft at Nationwide at the mo... how will this affect the sitch?

Hi there... We've opened up another account now, but what happens with the Nationwide account? It seems that previous Nationwide claimants have had monies paid into their Nationwide accounts...
Once you have won your claim Nationwide will pay the money into your account and then a few days later you will recieve a letter telling you that they will be closing your account in 30 days time:mad: That is why you must ensure that you open a new account.

Hello! I received a letter from Nationwide this morning thanking me for my letter blah blah blah, unable to refund any charges, lots of media speculation etc etc but basically telling me that they hope I can abide by the terms and conditions of my account and if not I must take my banking elsewhere...

 

What do I do now? do I wait for the end of the 14 days and then send a second letter giving them a further 14 days?

 

They included a final paragraph stating what to do if I am still unhappy, about using the Financial Services Authority and Financial Ombudsman Service... is all this their usual blurb or are they sharpening up their ability not to return charges?

 

HELP!!??

Personally I would move straight on to the LBA as they have responded to your prelimary letter negatively and are not likely to change their minds in the next few days. Though I know others suggest waiting until the 14 days has expired from the date of you Prelim. before sending your LBA. Not sure there is a right or wrong way to go about it, it's your choice.

It is suggested that you wait the full 14 days so that IF it should get to court you could show that you have allowed a reasonable period of time. I know they won't change their minds so I know what austenpowers is saying but to be on the safe side, I would wait.

Thanks Dolly, it's such a pleasure to have some support from people who know what they are talking about! I shall be away on the date my LBA needs to go, but I'll print it off and mail it while I'm in Devon on the correct date. Watch this space! Also, they just responded (on the same day as their letter telling me "no" on the refunds) that they refuse to reverse charges we incurred due to my husbands salary getting paid late, can I include these onto my claim and should I send an amended claim schedule with the LBA?

If the charges have already been debited from your account, just send a revised figure to them in the LBA. You could write something along the lines of 'The total now is £xxxxx because of additional charges on xx/xx/06'

 

If they haven't come out yet, you can't put them on at this stage but will be able to at Moneyclaim, providing they have been debited.

HELP! AM now at the MoneyClaim stage. I've gone thru the registration and am now filing in the particulars of the claim. Do I reserve the right to claim interest? I am now quietly terrified and am SURE I will be dragged through this to the bitter end and lose! I can't afford to lose any more money because of Nationwide.....

Yes, claim interest and remember to put that statement in about it.

Put your account number in the reference section.

If you want to post your particulars before you submit it so we can check, that's no problems and I'll look at it.

 

You will NOT be dragged through the courts - they paid out on an £11k claim the week before last.

OK.....amount box is total amount + the 8% interest

Daily rate is total amount EXCLUDING the charges x 0.00022 = £x.xx (usually about £0.15)

 

Copy and Paste your particulars in this thread and I'll look at it before you submit it - once you get to the payment screen on Moneyclaim and enter your payment details there is no chance to recheck it so post here first.

I wish to claim unfair bank charges incurred

over the last 6 years. The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from 20.3.2000 to 4.9.2006 of £3436.80 and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of ....

 

I'm so sorry for being a total ditz! But I've NO idea what to put in the last section of this paragraph!! I'm a mathmatical reject! I owe you a large G 'n' T, you prob need it by now dealing with me!! :eek:

The first lot of XX are the number of years you are claiming for (ie back to 2001 would be 5)

 

The xx/xx/xx to xx/xx/xx is date of your first charge to the date you submit the claim

 

The £xx.xx after that is the interest charge alone, not the charges

 

The final £0.XX is the Amount of Charges (NOT including the 8% interest) x 0.00022

 

And I don't take tonic with my Gin, I like it straight ;)
