After a successfull claim against the Halifax I decided to have a punt @ early redemption charges.

I fired a pre letter off on 10th July to Mortgage Express(part of bradford&bingley)

asking for a full breakdown of their costs incurred ( when they charged me a whopping £4,778 ,and a refund.

Concerned that I had no reply after the 14 days ,I decided to phone before sending a second letter. I spoke to a helpful young guy, who said he would make enquiries with the redemption dep and get back to me.

Having not heard anything I decided to draft my second letter and enclosed a copy of the first for good measure. Posted it last night. First thing this morning I picked up a voicemail message, from the same guy, he had returned the call.

Rang him this morning and apparently the official statement is that they have not received my letter. My reply being you must have filed it in the bin then?:rolleyes: I told him that he should expect to receive my next letter with a copy of the first enclosed by monday.

Lets see what happens.

After sending my letters again via recorded delivery ,I,ve just received their reply.

 

Dear Mr Maroonfox5

 

Thankyou for your telephone call on 3rd July (EH! NEVER PHONED THEM THEN JUST SEND A LETTER ON 10th July) DOH!!!!!!!regarding your complaint.

 

I an sorry that you are unhappy blah blah and complaint is being investigated through internal complaints procedure.

 

Will get back within 20 working days (WHAT ONE MONTH FROM NOW ,DON'T THINK SO).

 

If you would like to speak to one of our team in the meantime ,call the number at the top of letter.Thankyou for your patience.

Shoud I ring them and explain that we are working to my timetable or write to them instead?

Decided I'd ring and speak to them today and so I did just that.

 

Got through straight away on a direct dial number given in the letter.

 

Told them that they had until end of the week to respond as my last letter stated.

 

The lady in compaints after checking my details said that they would be replying to my letters by the end of this week.

Well .........Guess what ?

 

Received a reply fron Mortgage Express today.

 

Must say it is very polite and has been written by a customer relations officer.

 

These are the basics of their refusal cutting out the rubbish:-

 

1 You took out the mortgage and agreed to be bound by the terms and conditions.

 

2 Your account was on a preferential interest rate and within the ERC period.

 

3 Funds were purchased from the money markets and incurred fees paid by us.

 

4 Fees paid determine the charges we pass on to you.

 

5 If we didn't include the charge as part of your terms and condition we wouldn't be able to offer you the interest product we did.

 

6 ERC was correctly applied to your account.

 

 

Therefore we are not going to refund the ERC.:mad:

I am waiting for SAR - due by 6th Sept. My mortgage was sold to ME by GMAC I predict around £5000 ERC (I'm not mystic Meg just hazy memory!)

Well folks the moneyclaim went in on the 6th (no money to do it until now)

 

It cost me £250 for this one as I went over the 5K figure.

 

They have until the 25th to reply..........Lets see!

Have a look at SANDY VS GMAC RFC. Interesting development in court today on her thread. I am taking on Birmingham Midshires.I can't wait to get into the chambers for this one. I can't be scared off by Barristors in dodgy suits.

did you claim any penalty fees from ME or are you just claiming the ER.

That figure must be about 5%
