      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Chris

 

Received Cobblers AQ this morning. They are asking for schedule of charges again as they reckon they didnt see the one attached to the N1. Whats this all about? Should I send it again!

 

If you sent your N1 and schedule of charges by recorded delivery and you have proof that they were delivered - I wouldn't bother resending - why make life any easier for them?

 

If you haven't sent them recorded delivery, then I'd send them again - via recorded delivery of course!

00020072.gif why are cobbets making everyone offers but me! I had my AQ weeks ago and sent it back and received a copy of theirs earlier this week. no sign of an offer though. Maybe they want to go all the way.

I am in the same situation. Had an offer from Cobblers on Tuesday for half amount. Told them thanks, but no thanks. Had a letter from local court today to say that several similar cases are being heard at Bristol Mercantile Court in October, so they will hold on to my claim to see outcome.

:D hehehe, bet you all saw my name and thought I had got my money back, no such luck, I think they are waiting till we get a court date, and I havent been given one yet, phoned the court up to see what was happening, told no date set yet, so still waiting, the longer they take, the more interest for me lol

I ahve just received my court date, it is set for the 14th december and is allocated to the small claims track, so will start to get my documents together to send in to the court, if things go the same for me as they have for others, I will get paid out befor then, wonder how long the courts will let cobbetts waste their time like this?

Great news for you. Means you will get your money before xmas. I am about a week behind you so I hope I get a date soon. What documents would you be taking to court if you went? I havent even thought about that. Just assumed I would get my money before that happened.

How long ago was it? Natwest tend to wait until around the deadline time before they send the statements to you. Expect to receive a tatty brown envelope stuffed with statements in no particular order. One of the envelopes that I received was more open than it was closed - and I'm certainly not the only one.

 

Leave it until about day 35 (if you haven't already) as they'll take that long anyway. There are a few people who've managed to get hold of quite helpful people at Natwest who've sent them their statements quickly. If its getting near the deadline then try to use the search facility on this site to get the contact numbers.

I havent thought about what documents I will send in yet, I was going to look through a few threads and see what those that have gone before me have sent, I was hoping to get my money before court, but if I have to go to court, then I am ready and willing. :smile:

A big WELL DONE Chris, I've been having a good read through your thread and I'm going through that long boring wait at the moment, do they think we're going to give up or something. Well you've prooved that it pays to perservere, or should I say THEY PAY!!!
