Chris....if they have failed to supply your information via a SAR, then send a LETTER BEFORE ACTION give them a further 14 days to comply, enclose a copy of the original SAR letter. If they fail to respond then slap them in court... - (I wonder which solicitors they will use ? - if any !!) ;) This is an example of an LBE on this thread - http://www.consumeractiongroup.co.uk/forum/general-debt-issues/178660-blackheath-loans.html - This cagger took Lloyds to court for non compliance - http://www.consumeractiongroup.co.uk/forum/lloyds-bank/49571-havinastella-lloyds-tsb-3.html

Jogs was here yesterday-no doubt he will help out here.

He still needs to lodge a Complaint with the ICO though.

Hi Chris....ring the courts !! there are a couple of threads in the success forums where people have sent in the bailiffs....(Of course if you started a new thread in the Debt Collection Forum, i'm sure you'd get some great response !!!)

I would now take them to court for non-compliance with the SAR....time to turn the tables Chris....get in touch with Jogs.... - http://www.consumeractiongroup.co.uk/forum/lloyds-bank/49571-havinastella-lloyds-tsb-3.html

Update

Letter received today from First Revenue Assurance, I have never dealt with them before, but their registered address is the same as Vertex Data Science Ltd

Stating:-

Further to your recent letter (I assume by this they mean my 7 day letter) in relation to the above account, I can confirm that your query has been passed to our Data Protection Officer, (funny that as it was addressed to him at Vertex anyway  ) to investigate this claim.

As soon as their investigations are complete you will be informed of the outcome

etc etc

I guess they are now scratching around for paperwork :)

I would like to say a BIG WELL DONE. Amazing, to all parties involved. Fantastic case, I wished that I could have been a fly on the wall.

WELL DONE AGAIN. Now stick it to them.

Thanks Trooper, today I received a document from the court stating officially the SD had been set aside and that Vertex had to pay the costs by 4pm May 28th - no sign of payment yet, lets hope the Bailiffs make light work of it ;)

hi all been reading this with great interest-congratulations to you all - did not want to make this point whilst the ball was still rolling but i noticed that very early on chris said the he had moved house and that he thought the UU bills would haev been settled

at the time he made a SAR request to UU he would therefore have been living at an address that they did not recognise for him and so probably would have been right to insist on some form of ID before responding to the SAR?

just a though

The subject access request would have had the return address on it-so no excuses.

Any news on this yet ?

Problems with Court baliffs is that they are not quick to act-in fact it can be a week to 10 days after they get a warrant before they try to enforce it.

The other thing is that they give notice to the other side that they will be attending.they only work 10-4 5 days, and very rarely will make multiple visits.

An enforcement officer would have been better-there is a charge for this (Around £85) but they get this n top and do not mess around !!!

I sent them my new address that I have been at for a couple of years anyway, and I still use them for my water so they should know me, but it was a red herring anyway as it turns out to be nothing whatsoever to do with them, that was just Vertex not knowing their elbow from their ankle.

I take it they will be collecting from the Prescot office ?

Its strange how the warrant wasnt transferred to St.Helens Court Bailiffs for collection-its our area.

They may have done Martin, but I cannot actually speak with the Bailiffs themselves, until tomorrow, then they may be abole to tell me more, but from what I was told they have dozens of WoE to carry out.

Yeah Court Bailiffs are always busyI know one of the St.Helens ones-they are far more lenient than private Bailiff firms and will usually try to persuade businesses to sort the payment out over the phone before they go on a visit.

I reckon you could be looking at a week before you have the dosh.
