  • 8 months later...

i wrote to mbna november 2008 as i was in difficulties. they refused to help saying had i considered a secured loan. so i have struggled through the year paying what is effectively over 2000 pounds to find that a year later i owe more and have high interest rates, the minimum payment does not cover the interest etc etc they ring continually and even asked my young daughter to pass them on to any family member!

i am sure i am not the only one but it makes me feel helpless. Reading the threads helps but i am so angry that they can get away with this. I just want to get straight but they are not interested

You are not alone. They should not have suggested further borrowing to to clear your debt.

They are very unwilling to help anyone in dificulty.

Write to them telling them that you will only discuss the situation in writing, not over the phone as you are concerened with idendity theft. Stop speaking to them over the phone.

Then send off for a copy of your agreement.

xxxxxxxxxxxxxxxx 2009.

Dear Sir/Madam

With reference to the alleged debt to your company, this letter is a formal request of true copy of a signed and dated credit agreement for the above account number, under the terms and conditions of section 78(1) of the CCA act 1974. I enclose the statutory maximum fee of £1.00

I expect you to comply fully and properly with this request, within the statutory time limit.

I enclose a postal order no xxxxxxxxxxxxx in the sum of £1.00, which is the statutory fee. Note that these funds are not to be used for any other purpose.

If you are unable to comply fully and properly with this request, you should confirm this in writing at the earliest opportunity, and certainly within the statutory time limit for compliance, and return the fee.

I look forward to hearing from you.
