And so it finally arrives the letter from DG Solicitors offering the full amount of

£3417.40 which of course I will accept.

 

I need to sign the letter but I want to be paid by cheque should I send a letter requesting payment by cheque?

 

Should I set a deadline for when I want the money?

 

What do I do with regard to MCOL requiring judgement?

 

How long do you reckon I'll have to wait until I actually see the money?

 

I'm so pleased have just started the process against LLoyds for my wife!

Write you own letter of acceptance with just the conditions you agree to, making clear you will only withdraw claim upon clearance of their cheque.

Its anyones guess although they will be anxious for you to inform the court its settled,and quite possible that they have already done that themselves.

I completed moneyclaim online and D and G sent an offer for the full amount on 20th September, I sent my own letter 22nd September accepting the offer but requesting a cheque payment. I said I would withdraw the claim once the cheque cleared in my account.

 

Today as I'm looking out for the cheque I receive an allocation questionaire and a notification of transfer proceedings to Birmingham County Court from Northampton alongside a defense.

 

I don't what to do now.

Should I contact D and to ask them whats going on.

Plus they had 28 days from 25th August to file a defense but filed it on the 29th September.

Should the agreement with D and G and send it back or should I complete the allocation questionaire and send it to the court.

I thought I'd finished all this stuff ans I was waiting for the cheque Im absoluteley gutted now.

Hi,

 

In almost similar boat to you verses evil hsbc, my 28 days ends tomorrow and heard nothing. Seems as HSBC/DG have filed their defence too late against you surely, it HAS to be within 28 days from the start of issuing/serving the claim to HSBC, if they don't respond within the 28 days then you win by default. Your 28 days ends 22nd Sept. If they filed on 29th that is 7 days afterwards.

 

I'm not sure, and someone else will probably correct me as i may be wrong, but i would probably contact the MCOL helpdesk and ask them 4 advice and tell them what has happened so far, (note you'll have to ring them tomorrow from 9am - 5pm) Ive tried contacting people at DG and all you get is their bloody voice mails. Plus its pretty poor show of them not to send you the cheque. Who was your contact there?

I have spoken to D G this afternoon they me they are dealing with the payment I am due.

 

D G filed a defense against me to avoid a judgement

 

I have until 21st October to complete the Allocation Questionaire although I do expect to have a cheque sooner.

 

I suspect that this just a last ditch attempt to scare me off or that D G are as useless as HSBC

i, too, am in almost identical situation. received 100% offer 22 Sept., mailed acceptance, they got it monday 25th, tues, received all the court stuff, moving it to my local court and the a.q.(mine's due 14 oct). called dg. talked to julie kyle on thurs 28th, said much the same - they had to file defence on that day (by the way - from you filing, they give it 5 days to be "deemed served", and it's 28 days from the served date. when i checked it out on mcol - you can't press the button to continue after they have filed defence. i digress, julie kyle said we would have a letter shortly to confirm. Got letter today saying cheque will be here in 7 days (from her writing it, last friday), if not, call her and she will chase it up with the bank. so, i'm feeling better now. my personal plan, wait til friday - if cheque arrives - deposit it. if cheque doesn't arrive, call her friday and i will also write another letter telling them again that if the cheque hasn't arrived by thursday next week, i will be filing the a.q. and will need a further £100 to settle to cover the a.q. just to have it all on record. as michaelb. says - keep in the ballgame til the cheque arrives.

quick follow-up: has anyone else noticed no new "litigation concluded" postings for claims with HSBC? Not to sound too paranoid but I don't like it. The whole rest of the claim we just wrote, waited. Now that they have offered and we've agreed - the waiting is almost unbearable. I'll let you know when the money gets here - please, you guys let us know when yours arrives.

well done you!! i got my letter yesterday saying that hsbc are defending the claim and thought maybe ill have a settlement within a few days (NO CONTACT FROM THEM THOUGHOUT WHOLE CLAIM) but looking at your thread im still in for a long wait! o well at least we'll know were victorious!! happy spending!

17/10/06 - offer for £1600 on one account recieved

28/11/06 - Full offer recieved

 

Capital one - 13/9/06 -letter asking for statements sent

17/10/06 - prelim sent for £640

 

Lloyds TSB - 13/9/06 -letter asking for statements sent

17/10/06 - prelim sent fro £732

Lloyds TSB - 26/9/06 - prem letter sent - £391
