CCA Request - Cabot x 2 debts

Here is my CCA Request for Cabot for two different debts. Will keep you updated.

This letter is a formal request pursuant to s.77/78 of the Consumer Credit Act 1974. I require you to provide me with a true copy of the Credit Agreement relating to the above account, together with any other documentation the Act requires you to provide.

 

I expect you to comply fully and properly with this request, within the statutory time limit. You are reminded that should you fail to comply with my request, the provisions of s.77(6) will apply.

 

If it is your view that you are not the creditor, s.175 of the CCA 1974 applies in the case of a simple assignment, and places a duty upon you to pass this request to the creditor. In the case of an absolute assignment, you are a creditor as defined by s.189. If you contend that you purchased the rights but not the duties of any agreement, you are reminded that s.189 of the Act is clear that an assignment is of both rights and duties.

 

Your attention is drawn to ss.5(2), 3(b),6 and 7 of the Consumer Protection from Unfair Trading Regulations 2008 (CPUTR).

 

I enclose a cheque in the sum of £1.00, which is the statutory fee. Note that these funds are not to be used for any other purpose.

 

If you are unable to comply fully and properly with this request, you should confirm this in writing at the earliest opportunity, and certainly within the statutory time limit for compliance, and return the fee.

Just checked the Royal Mail website and they have received my letter on 28 Feb.

Here are the letters that I received from Crapbot.

 

They said that they are not obliged to send the Credit Agreement but as they are ever so kind (yeah right), they are going to get it for me from the original lender.

 

But I thought that they were obliged under the CCA Act, so why are they saying that they are not?

It makes them appear "friendly" and they hope that you do not know your rights;) .Have been waiting for several months for a CCA of them ,they send you a letter every few weeks saying they are still trying to get it of the original creditor, take forever as long as I am concerned!!!!!:)

Well its been very enlightening when I have just had a look at my Credit File with Equifax! As you can see from my Credit File below, Crapbot have entered a default against me for no reason for the two debts.

 

The first debt is for Hitachi Nova, which I have been paying since they first contacted me about it.

 

On the Credit File, there are the following mistakes:

 

1) The Account Type shows as Bank Default, which is incorrect. It was a finance company I had the debt with and not a bank.

 

2) It shows last updated in 21 January 2009 but the last time they updated the Payment History was in May 2007, even though I have been paying every month anyway (apart from this month).

 

 

 

The second debt is for Vanquis Credit Card, which they only told me about before Christmas 2008, when I was ringing to discuss the other debt. They told me that they had had the debt for several months but wasn't able to contact me, even though they had my address as they had been contacting me about the other debt, which I had been paying for months!

 

On the Credit File, there are the following mistakes:

 

1) It shows last updated in 21 January 2009 but the last time they updated the Payment History was in January 2008, even though I have been paying every month anyway (apart from this month).

 

 

 

Am I right in thinking that they should be updating the my Credit File every month?

 

Is there anyway that I can get these defaults removed on the basis of the above-mentioned inaccuracies?

 

If not, if they don't produce a copy of the Credit Agreements within the 12+2 deadline, can I get them removed somehow after they have defaulted on the CCA Request?

If they default on the CCA Request, how do I go about getting the debt removed from my Credit File?

 

And does anyone have a template letter that I can send when they do default on my CCA Request?

You can send this letter if they fail to send you a copy of your agreement (sorry I meant to post it much earlier!! Use this same letter with all the DCA's you have CCA'd if you get no response)

 

Dear Sir/Madam

 

I DO NOT ACKNOWLEDGE ANY DEBT

 

ACCOUNT IN DISPUTE

 

Thank you for your letter of xx/xx/xx, the contents of which have been noted.

 

You have failed to respond to my legal request to supply me a true copy of the original Consumer Credit Agreement for the above account.

 

On **DATE** I made a formal request for a true signed agreement for the alleged account under consumer credit Act 1974 s77/8. A copy of which is enclosed for your perusal and ease of reference.

 

You have failed to comply with my request, and as such the account is now in default as of **DATE**.(12+2 days after you sent the CCA request)

 

The document that you are obliged to send me is a true copy of the executed agreement that contained all of the prescribed terms, all other required terms and statutory notices and was signed by both your company and myself as defined in section 61(1) of CCA 74 and subsequent Statutory Instruments. If the executed agreement contained any reference to any other document, you are also obliged to send me a copy of that document.In addition a full statement of this account should have been sent to me detailing all debits and credits to the account.

 

Furthermore;

 

You are aware that the Consumer Credit Act allows 12 working days for a request for a true copy of a credit agreement to be carried out before your client enters into a default situation. This limit has expired

 

As you are no doubt aware section 78(6) states:

 

If the creditor fails to comply with Subsection (1)(a) He is not entitled , while the default continues, to enforce the agreement.Therefore this account has become unenforceable at law.

 

As you have Failed to comply with a lawful request for a true, signed copy of the said agreement and other relevant documents mentioned in it, Failed to send a full statement of the account and Failed to provide any of the documentation requested. Consequentially any legal action you pursue will be averred as both UNLAWFUL and VEXATIOUS. Furthermore I shall counterclaim that any such action constitutes unlawful harassment.

 

Please note you may also consider this letter as a statutory notice under section 10 of the Data Protection Act to cease processing any data in relation to this account with immediate effect. This means you must remove all information regarding this account from your own internal records and from my records with any credit reference agencies.

 

Should you refuse to comply, you must within 21 days provide me with a detailed breakdown of your reasoning behind continuing to process my data. It is not sufficient to simply state that you have a ‘legal right’; You must outline your reasoning in this matter and state upon which legislation this reasoning depends. Should you not respond within 14 days I expect that this means you agree to remove all such data.

 

Furthermore you should be aware that a creditor is not permitted to take ANY action against an account whilst it remains in dispute.

The lack of a credit agreement is a very clear dispute and as such the following applies.

 

* You may not demand any payment on the account, nor am I obliged to offer any payment to you.

* You may not add further interest or any charges to the account.

* You may not pass the account to a third party.

* You may not register any information in respect of the account with any credit reference agency.

* You may not issue a default notice related to the account.

 

I reserve the right to report your actions to any such regulatory authorities as I see fit. You have 14 days from receiving this letter to contact me with your intentions to resolve this matter which is now a formal complaint. I therefore request a copy of your official complaints procedure which you are obliged to supply.

I would appreciate your due diligence in this matter.

I look forward to hearing from you in writing.

To properly serve the S10 under ICO guidance it should -

 

1.Be addressed to the data controller/compliance manager.

2.Give a date whereupon processing of data should be stopped-this must give reasonable time for compliance.

3.State reasons why the continuing to process data is likely to cause damage, distress,or harm.

 

 

My personal opinion Andy is that you should serve the s10 on its own.

Please be advised that this is a formal notice issued under Section 10 of the Data Protection Act 1980.

 

I demand that you cease processing of my Data by any means whether written or electronically, with third party, individuals and organisations. In addition to processing, this also means passing, amending, sharing and management in any form of my Data in whatsoever filing, both manually or electronically.

 

In compliance with the Information Commissioners guidance, I give you 14 days to comply with this request.

 

The purpose of this request is that I am of the understanding that your continual processing/controlling of my data will cause distress harm and damage. Specifically because;

 

My credit worthiness is being or has been damaged by your actions as a result of your entries to my credit files.

 

That I fully expect to show that adverse data was wrongly filed which would mean that earlier processing was unfair and unjust.

 

That matters in relation to adverse data you have entered onto my credit files are currently in dispute.

 

That the adverse data you continue to process, manage and pass on to third parties impedes my ability to apply for credit, mortgages or other financial services

 

That as a Data Controller/Compliance Officer, you have a responsibility under the Data Protection Act to observe all principles set out therein, within the act.

 

I expect an acknowledgement of your intentions to comply, and if you do not agree, your reasons for being unable or unwilling to do so.

 

You have until 6 April 2009 to forward this to me in writing.

 

Under the Data Protection Act, a County Court has the powers to order compliance of any breaches it sees fit, together with compensation, at the discretion of the Court.

 

Should you fail to comply, or give just and reasonable reasons as to why you will not comply, I will consider making an application to my local County Court on notice to force compliance, together with costs and compensation.

I'm just about to send a similar letter to Cabot. I have an old debt which, when asked for a CCA, they have failed to reply.

 

Would you mind posting copies of your S10 & Default letters (without your details of course :) ). I'd like to make sure mine is worded as best it can be.

 

Please keep this thread updated with how you get on - it's really appreciated

:)I am not an expert, but I can give good advice about Brighthouse:)

 

Am learning more and more about DCA's too :)

 

I have no legal experience and all advice given is based on the knowledge I've gained from this site.
