    • 4 means that they need to name and then tell the people who will be affected that there has been an application made, what the application relates to (specificially "whether it relates to the exercise of the court’s jurisdiction in relation to P’s property and affairs, or P’s personal welfare, or to both) and what this application contains (i.e what order they want made as a result of it) 5 just means that teh court think it is important that the relevant people are notified 7 means that the court need more information to make the application, hence they have then made the order of paragraph 1 which requires the applicant to do more - this means the court can't make a decision with the current information, and need more, hence paragraph one of the order is for the applicant to do more. paragraph 3 of the order gives you the ability to have it set aside, although if it was made in january you are very late. Were you notiifed of the application or not?

    • Hi, In my last post I mentioned I had received an email from SS who were asking me to hand over the keys to my mother’s flat so they could pass them to the Law firm who have been appointed court of protection to access, secure and insure my mother’s property.  Feeling this, all quickly getting out of my hands I emailed ss requesting proof of this. I HAVEN’T HEARD BACK FROM SS.  Yesterday, I received an email (with attached court of protection order) from the Law Firm confirming this was correct (please see below a copy of this).  After reading the court of protection order I do have some concerns about it:   (a)   I only found out yesterday, the Law firm had been appointed by the court back in January.  Up until now, I have not received any notification regarding this.  (b)   Section 2   - States I am estranged from my mother.  This is NOT CORRECT    The only reason I stepped back from my mother was to protect myself from the guy (groomer) who had befriended her & was very aggressive towards me & because of my mother’s dementia she had become aggressive also.  I constantly tried to warned SS about this guy's manipulative behaviour towards my mother and his increasing aggressiveness towards me (as mentioned in previous posts).  Each time I was ignored.  Instead, SS encouraged his involvement with my mother – including him in her care plans and mental health assessments.   I was literally pushed out because I feared him and my mother’s increasing aggression towards me. Up until I stepped back, I had always looked after my mother and since her admission to the care home, I visit regularly.   .(c)    Sections -  4, 5 and 7  I am struggling to understand these as I don’t have a legal background.  I was wondering if there is anyone who might be able to explain what they mean.  It’s been a horrendous situation where I had to walk away from my mother at her most vulnerable because of; ss (not helping), scammer and groomer. I have no legal background, nor experience in highly manipulative people or an understanding of how the SS system operates, finding myself isolated, scared and powerless to the point I haven’t collected my personal belongings and items for my mother’s room in the care home.  Sadly, the court has only had heard one version of this story SS’s, and based their decision on that.     • Unless I've got an incorrect copy of the relevant regulation: The PCN is only deemed to have arrived two days after dispatch "unless the contrary is proved" in which case date of delivery does matter (not just date of posting) and I would like clarification of the required standard of proof. It seems perhaps this hasn't been tested. Since post is now barcoded for the Post Office's own tracking purposes perhaps there is some way I can get that evidence from the Post Office...

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

bought a acer pc 18 months ago, within the first 12 months replaced both hard drive and dvd cable, since the warranty has run out have had to have,

hard drive again,

motherboard (1)

the pc has been down for a month, have had 4 engineers out, one non appointment which my wife had to stop in all day for someone who did not turn up,

in 4 weeks the computer has had a full system revcovery as well as, plus we are now awaiting the following

power supply

cpu

motherboard (2nd) which will take another 7-10 working days, in the last month the pc has not run at all and even though we have support package i am getting more and more frustrated.

have asked for a replacement no joy, they state the terms of the contract which says we have to wait 6 weeks.

what can i do next the unit cost £350 + is totally unreliable

any ideas:confused:

Well, under the terms of your pc performance agreement, they have 28 days from the date the fault was reported, to fix or replace your PC, so if they're still waiting on parts it's tough. If you ring them up and tell them they're over 28 days they'll usualy issue you with vouchers to get a new one of the same specification from a PC world or currys. Issuing vouchers can take upto 10 days.

 

Also, your computer can only be sent for repair a maximum of 3 times, before they have to replace it.

 

Unfortunately you did sign a service agreement, and whilst it does give you additional benefits over the manufactorers warantee, it also means you've agreed to their timeframes for fixing your computer.

I have gathered many pieces of information from many sources to know this. under the first year, manufacturer or support package if the system still does not function you can request a replacement after 4 weeks of fault coming to pcworld/ pcperformance, whatever happens, techguys attention.

 

in your case it is 18 months old so now the repair limit time is 6 weeks. well after the February post you wrote, then i believe its time for that 6 week thing they talk about to be used.

 

if only DSGI had the brains. i mean if it was 4 weeks in february they said it would take a further 7 to 10 business days then i would have said, "do the maths sonny thats then my 6 week rule. "

 

"i would like to request that now."

 

id ask them who is in charge of the decisions about the 6 week rule, if there is the insurance department of DSGI or a pcporformance supervisor rather then them, the general call center.

 

ask to be put through to that department/person and again request the 6 week rule

they are coming out on thursday, 3 days before the 6 week deadline , have asked for a replacement response was 'no' have contacted acer and because i got it from pc world they are not interested, i feel so frustrated with it all.

Well under law, they are entitled to a reasonable period of time to repair anything. Reasonable being determined by how much inconvinence being without the item would cause you. And to be honest, compaired to something like a washing machine or cooker, losing a laptop for 28 days is hardly devastating.

 

Personaly, being a company that sells and repairs thousands of laptops a year, I'd say that 28 days to collect, diognose, order parts, repair and test your laptop isn't too bad.

 

Just roll with it, let them try and fix it, they have 3 days or they'll have to send you vouchers.

 

Once you do request vouchers, you'll need to ring up whateverhappens/PCPlan/Mastercare/Whatever name they're going under this month, and not the techguys, they'll get a damage report from the techguys, and a writeoff from the underwriters, and issue and post your vouchers, this usualy takes about 10 days.

the point that i am putting across is as follows

10 day wait for engineer agreement states 3 days (not awaiting parts)

4 day wait for tech guy (promised 1 hour), 1 appointment not met.

when it is repaired how reliable will it be, every major part has been replaced!

unfortunately i have very little confidence in this pc we have had so many problems, also acer are not willing to act as i got it from pc world so dealing with the manufacturer is not an option

the tech guy came with the part that took 10 days to order and guess what, the old one was not faulty:mad:

he then fitted new motherboard, cpu and ram and powered computer up , then left for us to finish re-installation, problem was it kept showing up as a error so another phone call, and we were then told that we need some recovery discs which will take another 7-10 days , pantomine stuff.

contacted acer and they told me its nothing to do with them as pc world have taken over their warranty.

its 6 weeks since it last worked:cry:and were no further forward.

The reason they wont budge here is because you didnt create any recovery discs, you have had 18 Months to create them, and they arent obliged to replace these discs either. fortunately they have ordered some for you.

If the machine doesnt correctly run after the recovery, you will definately have the machine written off.

what amazes me is that the 6 times they have visited they have never stayed long enough to get it up and running before they have left, always leaving us to complete re-installation, which has never worked,the problem that i now have is how i replace it, the acer was a micro tower, ive only seen dell that do that sort now and dont know what the procedure is anyway for replacement.

To be honest, if it's a micro tower, it's no wonder they can't get parts for it to fix it. They're next to impossible to upgrade let alone repair.

 

If I were you I'd stick with a micro ATX or standard ATX case size, if anything. It saves SO many headaches in the future, if you upgrade or seek a repair.

Have had a response from insurance company, getting credit note for £320, so now looking for a new pc tower and there dosnt seem to be a great choice, any help on this one ? would be willing to put a bit more too, any recommendations.

also do i have to send the old unit back now its written off or what,

hoping for a little help on this.

as i cant go into control panel all i can tell you is it is a acer aspire L100, it was a form of micro tower, also the £320 will be sent in vouchers in a day or 2, as yet they havnt arrived should be here by weekend but i dont know if they are just for currys/comet

Assuming you wanted another slimline pc, you could go for the advent eco PC, product code: 609401

 

pretty similar spec to your old one.

 

Or for a fullsize tower you could get the compaq SR5715, which is alot better than your old one, product code: 554085.

Reasons being, I'm a fully qualified PC Techy, and the number of Advent Towers / Laptops, which come into the store, is beyond belief.

 

IMO the Compaq sounds the better choice, I agree with Renz on this one. I would opt for which ever model has the best cpu / graphics combination possible. Memory and Hard Drive, can be upgraded very easily, and at the moment are really cheap too.

I agree, the advent was one of only 3 slimline PC's they stock on their website right now. The other being an over priced dell, and an under-performing asus eepc.

Personally, and again this is my opinion, I wouldnt touch Advent with a barge pole. (purely based on running my own computer business for the past 6 years, and with over 10 years of pc building experience behind me, and seeing all makes and models of pc's come through my workshop, Advent are the worst make. When things go wrong, they really go wrong.)

 

You would be far better off with the Compaq SR5715 which Renz mentioned earlier in the thread. I cant see from the description if it has a separate graphics slot or not. If it has, this would be the one I would go for.

 

This has more processing power, larger memory, and a larger hard drive.

 

This is pretty top spec, unless you start thinking of going Quad core. And unless your a hardened gamer, hard core bencher, or a multimedia freak - no pun intended the quad core would be wasted.

 

If I can help any more, please don't hesitate to shout.

replacement vouchers gave the compaq as a equivalent match, went into store and made enquiries was then told that for compaq it was vouchers +£20 cash, told them no chance so in the end they did a straight swap,

will see how it goes now!
