It's an enforceable invoice. You don't have to pay whether you live in Britain or Swaziland.

 

Ignore it. You won't get any follow up junk letters anyway. They don't know where you live.

thanks guy's for all your advice, much appreciated, it's quite amusing now reading all the responses and I will post further communication from them..

 

To Bubblecat, do you have the link for the DCA thread, as I cannot find it!?

Out of interest. Anyone noticed National Clamps registered company address on their letters. PO Box 3188, Road Town, Torlola, BRITISH VIRGIN ISLANDS.

 

How does that compare with what is registered at companies house?

MBNA - Agreed to refund £970 in full without conditions. Cheque received Sat 5th Aug.:D

Lloyds - Settled for an undisclosed sum.:D

Hi All again,

 

Well....it went all quiet for a month. I thought that may be the end of this, then I received this yesterday from a " Debt Recovery" bailiff company.

 

Now I dont know what to do, if I should respond in a certain way or just ignore. Do you think they can take me to court??

 

Any suggestions or advice much appreciated on to my next step....

I viewed a thread on moneysavingexpert.com, and someone received same sort of letter x 2 from this debt recovery plus agent. They ignored and then received some sort of claim form from their local county court? not sure what that would be.....

I viewed a thread on moneysavingexpert.com, and someone received same sort of letter x 2 from this debt recovery plus agent. They ignored and then received some sort of claim form from their local county court? not sure what that would be.....

 

County Court papers will (or are) usually from Northampton County Court who do all the bulk work. The papers will be stamped (important as many DCAs send these to people unstamped fooling those into paying) and will have the Court insignia on the top etc. If unsure post here. I really cant see it coming to that though so try not to be too discerned. The letters that NC have sent are truly awful and would fall down at the first hurdle in court.

Don't be swayed by all of the nasty threats of what will happen. What the letter fails to say, as always, is that they first off have to

a) actually be stupid enough to want to go to court

b) turn up at YOUR local court with the expense that it incurrs

c) prove to a judge that they are entitled to the money that they are claiming, giving you the chance to put forward a defence which the people on this board will no doubt help you with (look at what has happened to Excel when they have tried going to court.

d) If by some sheer fluke you lose (chance about 0.5%) you can always pay them within 30 days.

e) if you don't pay, they still have to go back to court, giving you a second chance to defend your actions.

Up until this point, they cannot carry out ANY of the threats that they have listed.

 

All of this will take at least a year, by which time they would have got very fed up, and well out of pocket.
