Hi, im new here but we are out of the contract with talk talk, we received no bill for January and at the weekend we received a bill for £75, £50 from January and £25 for Febuary, we rung up to ask for a statement of calls, nothing arrived then yesterday a company called Roxbourgh rang up wanting £93.73, this includes a handling charge for them, so rung talk talk and they say we can pay them the £75 but would still have the pay this handling charge, do es any1 know where we go from here as i really dnt think we should pay this

thanks

They have a duty to provide you with accurate billing, however if you have received other bills, it is unreasonable to blame them for somehow not sending a bill when they invariably do.

That said, since you do receive a regular bill, it would be a self-defeating argument to say that if you don't receive a bill you don't owe them anything. This should have alerted you that something was amiss, and allow you to chase up the matter and resolve it before the matter was passed to a DCA.

Under the circumstances, you've asked for the missing bill to be replaces, so once you receive it pay them in full and reject the DCA's involvement, stating that you pay on receipt of all bills, and you didn't receive it until (state date). Hopefully the dispute will end there.

Thanks for replying, we rung talk talk at end of January to query the no bill and he said they will send another out, which was not receied until the one for £75, we told them we could pay this this friday and they said it would be ok, then a company are now asking for this plus a charge, so do we pay talk talk direct then refuse to pay the other company the charge

thanks

Absolutely. TT should have prevented the referral to the DCA as you had been in contact, so someone has slipped up. You are effectively in dispute with TT, so sent a quick note to the DCA that TT are aware of you not having received your bill, and as such have no intention in becoming involved with needless additional correspondence. :)
