I am currently paying money to Robinson Way and have ask them to send me proof of the debt, however this was on one of their many phone calls and all they did was recite some account numbers which I am supposedly due money to.

 

I am going to write and ask for copies of the CCA's but was wondering if I would have signed a CCA for a bank overdraft?:confused:

 

Any feedback would be greatly appreciated.

Hi,

Overdrafts are not covered by the CCA so no point asking for one.

 

What you could do is SAR the bank and get your charges (if any) refunded.

It costs £10 to get it

send a postal order, no cheques

send recorded delivery

wait 40 days

Once that comes back you will be able to work out how much they have taken off you in penalty charges.

Thanks for your reply Silverfox. I am also paying them for two loan accounts, therefore I presume I ask Robinson for CCA's for these.

 

Sorry this may sound stupid, but just to confirm I send the SAR to the bank even though it is Robinson I am paying.

 

Just a little background, this overdraft was on a student account which according to my CR defaulted in 2004.

Yes, CCA Robinson for the loans, and the SAR to the Origional Creditor.

On holiday today and am trying to get the ball rolling in regards to getting a CCA, etc.

 

Looking at the letter from RWay I notice that they only quote one account number, I know in the previous threads I have said that I know that this is for 2 loans and an overdraft, but I don't I have this in writing from RWay.

 

My question is should I send one letter & £1 PO in regard to the one account number they are refering to, or should I be proactive and send £2 as I know that it covers two accounts.

 

Any suggestions?
