You want to know what is there – but also very importantly you want to know what is not there. For instance, the email that they said they sent you before responding to the SAR – did you see that? Is there any trace of of the phone call that you made to the woman who didn't know anything about SAR's? On what basis was the £50 sent to you? Was it unilateral or did they offer it and you accepted it on some condition? When did they send you this £50 cheque? Have you banked it? Also, I think that we need to start understanding what you have lost here. Have you lost any money – and if so how much? Send the SAR to your bank as advised above

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

 

I got the 15gb 3 mobile broadband on an 18 month contract about 6 months ago. Last month i moved home, and my new home doesn't have any reception for the mobile broadband - it won't even connect. I emailed 3 customer services and they said that because the contract was taken out at an address that they could offer the service to, then i must honour the contract or pay over £400 to end the contract early (!!!).

 

I find it ridiculous that i'm having to pay for a service that cannot be provided. Do i have any rights to cancel the contract (without paying any fee or the remaining 12 months) due to lack of service or something?

Mmmm....

 

Ordinarily I would say that you are still bound by the T&C of the agreement as the network provider cannot be held liable for, nor foresee, you moving from one area which has coverage to another which has no coverage.

 

However, looking through the T&C for 3, section 10.2c might actually give you a get out clause.

 

"© no network access or 3 Services. We may end

your agreement if we no longer have access

to other operators’ networks which we need to

provide 3 Services, or if we are no longer able

to provide 3 Services due to factors beyond our

control or because we cease business."

 

The crucial part begin highlighted.

 

As 3 are reliant on another network provider, IIRC T-Mobile, to give them the coverage in any given area, and the fact that you have no 3G coverage which is essential for mobile broadband, I would say that on this occasion you have a strong case for early termination without charge as 3 do not have the required access. By this clause, 3 should actually be ending your agreement on their part :)

The advice I give in relation to benefits should be viewed as general advice and not specific to your individual claim circumstances. I cannot give specific advice on your claim as I cannot access the claim.

No - you're stuffed. What installspark referred to is the arrangement 3UK has with Orange to provide 2G connectivity when their network cannot provide adequate coverage, however this does NOT apply to 3G Data, as Orange do not provide 3UK with 3G backup - only 2.5G.

 

As your contract specifically excludes non-performance or service issues, you cannot hope to break the contract because of the relocation, as they never guaranteed 100 coverage. Your only option is to use a service like CellSwap UK to find someone to take on your contract.

 

Should you refuse to pay, your service will be terminated and a default flagged on your credit file.

IIRC, Three will allow the contract to be passed to another person as long as you give permission and the other person is "acceptable" to Three. I think you also have to be at least six months into the contract.

 

"Acceptable" means they can pass three's credit check over the phone.

In addition to Orange providing the 2g backup, didn't three set up a joint venture with T-mobile for their 3g and HSDPA networks?

People had the Devil's own job getting three to honour this 2 or 3 years ago when they switched from o2 to Orange for their 2g backup - people with o2 coverage but no Orange coverage.

You could try convincing them that your house move is a factor beyond their control, which has resulted in their no longer being able to provide 3 Services. (-;

I'll have a look at that cellswap - haven't heard of it before, but was wondering if 3 will allow it? Would they have any issues with someone else taking over my contract?

 

 

It's in your contract - you are allowed to assign the contract to a third party, but as previously noted they must pass their credit check, as not to do so would provide a loophole they wouldn't want!
