i just found out barclays sold my acount to roxburghe http://www.roxburghe.com

 

however HFO Services Claim they purchased the debt of Barclay card. is this right? can another company claim they are collecting for Barclaycard when they are collecting for Roxburghe?

 

any help would be appriciated

 

I also found out the oust standing debt barclays gave to Roxburghe was £2096 HFO are chasing 2750 plus charging interest everyday is this legal?

 

How did you obtain this information, have you got this in writing?

thanks guys i did set up a payment plan when they first called me because of the threats of baliffs would turn up to my house and court action. how ever i immediatly stop payment when i did not receive a cca back from them.

 

i will speak with barclaycard later on today and find out when last payment would receieved.

 

could i tell them to pass the debt back to barclaycard because the amount hfo is chasing is almost double to what was actually on the card?

 

also i noticed on the cca that it shows protection for job loss and around the time i could not pay the debt i told barclaycard lost my job and they were un willing to help me. hmmm

Who informed you the account was sold to Roxburghe do you have this in writing?

HFO have BOUGHT this off Barclaycard, no way it can be sent back to them. Barclaycard are still obliged to give you information about it. When did you make a payment to HFO? Cannot see your posted docs

professional journals I some time read

when bored, that quite often there is

built in to debt portfolio sale provision

for debt to be returned to the OC, sort

sale or return basis, and indeed I have

on case where this has happened and

is recorded on the clients CRA files????

Is this the case with the Barclaycard accounts then? I have heard of it when an account is found to be fraudulent and the like, but not sure it is something you can ask for.

If the third party has not had notice of the assignment, then the third party is entitled to continue to make payments to the assignor, although I doubt the assignor would accept payment.

I believe it is founded in EU legislation,

and from what I remember it was concerned

with debt that either could not be proved,

or there disputes that were impossible to resolve

etc.,

Sort of a guarantee on the poor debt purchaser

being stuck with a dead duck.

I'll try and find the journal when next in the office as

at present I am deployed elsewhere.

Hi guys

 

The EU Credit Directive is very clear. If a bandit asks me to pay it rather than the OC (or some previously agreed bandit [but we should not have gone there]) then it has to provide a NoA and accept responsibility for consumer law compliance regardless of whether the account has been equitably or absolutely assigned; in other words, the Directive (UK law) uses different meanings of assignment to CCA UK law. I have found that asking this simples question tends to lead to departure of bandit and associated legal honcho.

 

I keep banging on about this and will start a thread when I have time; but it dovetails nicely darling with the splendid CPUTR thread.

 

Quoting EU law is also a helpful forward echo towards Human Rights Article 6 which I think might make errant DJs study the law.

 

Anyway, repeated rant over.... for now.
