I have told them how remorseful I feel and how a criminal conviction would result in expulsion from my degree but they still want to take me to court. I have received the court summons letter

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi guys can anyone help

Having read though the mis sold ppi theads i was wondering if payment protection plan is the same as payment protection insurance.

 

I got a 4000.00 pound loan out in 2002 and with having read though the thread i decided to have a look at my agreement and it says nothing about ppi but ppp costing me a extra 792.00 pound :-|

Both the same althouth the correct term is PPI but hey some companies like to confuse us

Before you send of the request for a refund you need to know how much you are claiming so only the letter above can get you that info also remember if the ppi is on a credit card you will need all the statements to see how much you paid each month.

Hi guy just got a phone call from a company call claims direct saying how a have been sold p.p.i. by blackhorse loans.

HOW DID THEY KNOW I HAD A LOAN AND I HAD BEEN SOLD PPI.?????

If the do all the paperwork and i win they get 30% of the amount i get back.hahahaha

Ok all sent a subject access request on the 6/4/09 and the 10 pound postorder recorded delivery but i have still not had any reply.

Can any 1 help with what i do now thanks len.

I have still not received Consumer Credit Agreements with associated paperwork on four of the loans. Because of the inordinate delays, the information requested on the first loan which was refinanced in March 2002 would be of no use as any claim against that loan would now be statute barred within the Scottish Courts.

I have not received data in the name of recordings of telephone conversations or transcripts of those conversations between the RBS and myself.

I have not received copies of emails or letters which I know exist.

I have also not received any properly certified documentation by Data Controllers within the RBS stating the information that I have requested has been disposed of, destroyed or erased.

 

The Royal Bank of Scotland is a member of the British Bankers Association (BBA), is licensed by the Financial Services Authority and should I believe, operate within the Law of the Land and therefore respond within the statutory timescales within Legal Acts at Law, namely the Data Protection Act 1998.

 

I have, when asked, provided information to the RBS, but it seems to me now, that they will try and delay supplying the data requested by using whatever delaying tactics they see fit. On one occasion referring me back to DLFS for the information I had requested. The fact that the DLFS had been legally transferred back to the RBS on 1 March 2006 (the transfer included all DLFS loans) was obviously overlooked by the Data Protection staff within the RBS.

This is indeed an extremely sorry state of affairs and it beggars belief that RBS staff would not be aware this Legal transfer had taken place.

 

My understanding is that the RBS had 40 days to fully supply all the information requested in my Subject Access Request, this has most certainly not happened.

 

I would therefore like to request that each addressee takes the appropriate measures to instruct or at least direct the RBS to supply this information to me as a matter of urgency.

 

I have a complaint lodged with the Information Commissioners Office Case Reference xxxxxx

I would now urge the Commissioner to consider an Enforcement notice against the RBS under Section 40 of the Data Protection Act.

I would also request that the Financial Services Authority, the Financial Ombudsman Service, the Office of Fair Trading and the British Bankers Association add this extremely serious complaint to their files on the Royal Bank of Scotland.

Hi guys finally got all my fathers statements today .He has payed 1214.67 plus 8% interest over 7 YEARS can he still claim. he is 63 and not worked foe over 10 years. what is my next step any help please thanks

 

Don't see why a claim cannot be submitted. However what is the position on your action?

 

Did you get more than just statements ie CCA etc.

 

If you did it is now time to send a letter reclaiming the full amount of the PPI plus the contractual interest on that PPI and also ask for 8% statutory interest. As he has not worked for 10 years the PPI was clearly mis-sold. You should perhaps suggest that a negative response to your request will result in a formal complaint to the Financial Ombudsman Service. This complaint will of course result in a £500 fee to the Ombudsman.;)

Data Protection Act - Non-Compliance - Template Letters

 

Use this template and include everything else you want them to supply.

 

You should request the following documents:

 

A true copy of your Consumer Credit Agreement with the Terms and Conditions that were applicable at the time you took the loan.

 

Copies of all statements applicable to the loan. (Already received)

 

Copies of all correspondence that apply to you as a data subject ie letters, emails, faxes etc.

 

Copies of all recorded telephone calls or transcripts of the recordings.

 

A copy of the needs and wants/ customer duty of care questionnaire... here is an example.

Hi guys got a letter from barclaycard about my ppi claim.

They say i need to fill in a questionnaire to help them with there investigation is this a stalling point and do i have to fill it in as i gave them all the information they need in my letter :mad:

Yes a classic stalling tactic hoping you will go away but poor them because that's not going to happen is it.

 

Right how long have they been dealing with the claim for because if its more than 8 weeks you can pass the complaint over to the FOS to deal with.

 

Firstly I would send a letter stating that you fail to see why you need to fill the form in or its relevance to your claim as you already have all the data you need to investigate my PPI complaint and that you feel this is a delaying tactic which you are aware goes on widely in the financial industry.

 

Also make it known that you are fully aware of the amount of complaints the FOS receives regarding Barclaycard and if you do not comply this complaint will be another on its way to the FOS resulting in another £500 fee for you to pay.

Hi guys can anyone help me but a letter together?

Sent the questionnaire to help them with there investigation with a letter saying that i was not happy and the questionnaire as i belive this was a delaying tactic but i still have not recived a reply from b/c.
