Hiya debt free and welcome to the CAG :)

you can claim back any dubious charges and interest on those charges and you can prove that a debt is unenforceable but its doubtfully you can do both at the same time.

Here's one I did earlier on the same subject :)

hi, a little while ago i have asked my bank to consider my offer of a small monthly payment as i am having financial hardship, they first didn't respond to my letters for months and carried on chasing me for payments. i have complained internally and they have frozen interest on some accounts and accepted my offer of payment only for 3 months, after that they have passed my debt to a debt collections agency who chased me for higher paymentd and stuck with my guns and said i'll only pay what i can, after few months later that company has now passed it on to another debt collections agency who are very rude and have forced payments of me a little higher than i aggreed at first, they said that my budget form that i had sent stating what my income and outgoings was not acceptable for them, they said that my income at same cases were to high. what can i do now?

just write to them stating that they havent replied to your section 78 letter so the debt is uninforceable until they do and stop paying them :)

I'll get all the threads combined so we know whats going on :)
