      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hmmm good that they'll process it as soon as you fill in the form and send it back but is it just me that feels they dont really know what securitisation is and hence dont know if its applicable to the act?

Or worse.. my first thought was that the ICO want to calculate what the potential profit lose for the creditors could be before giving an answer.

 

As we know, most of the aims of the so called regulatory bodies (ICO, FSA, FOS TS etc) is to protect their powerful cousins in big business against massive loss. With this as an example... why need a specific case? The question is actually quite straight forward after all?

 

Perhaps i am paranoid.. i will send the complaint off along with a copy of the email and we shall see what the response is....

True.. makes you wonder.. it's a great excuse not to launch an immediate investigation: "Sorry, snowed under, will do it one day tho".

 

No further foward no. No contact from NCO/RMA. TS told me to get stuffed and i haven't bothered to reply to them. Was all geared up for it but i have lots on at the mo (for different reasons) and for now really only need to spend time writing letters that are either going to have an effect or get a positive result. Therefore the stinking useless and cowardly TS are at the bottom of the list.

 

I am considering this for any further DCAs via amex to save some time until such time that i.. A. Start Court action or B. Get a Solicitor to take them all the way to Court:

Ah well, that's it then!...the game's up now Davey. Nobody ever escapes the claws of AIC! Well, er, except everyone who ever tells this bunch of low down lying vermin to bog off. ;)

 

Where is that nice Mr Gilmour these days? He's my favourite. One day I might just hop on a train and go see him - no threat, just want to know what the worm looks like.

Subscribing to this thread with interest.

I have my own thread with amex that concerns 2 accounts that i cca'd.

Also had dealings with rma and westminsters threatening all sorts but that was before i sent in the cca request,had nothing from them since and its taken amex 3 months to reply,usual defective default notice as well.

 

They replied with an application form for just one account,nothing for the other,told me it was enforceable and also that they only have the current t+c's etc !

I'm constructin a reply but will read this thread later and see if its similar,.

Good luck with the crusade mate,you look to have it under control.

Hi mate,

been subscribing to your thread as i'm in a battle with amex ,i'll update it later but just to let you know that i recently received a letter from United Credit Alliance (sounds like a task force !!) asking me when i was going to pay up.They're acting on behalf of amex apparently,i'd heard nothing from them for months,a bit like you.

I have 2 amex accounts and cca'd them mid last year,received the basic application form for one and nothing for the other ! Needless to say a suitably worded reply is winging its way to uca !

It seems Amex have found a way to produce a rabbit out of a hat, albeit one in wolf's clothing & I suspect they are now chasing up on previously unenforceable debts with a view to producing this newly found evidence in court.

Usual DCA Lawyer Threats.

 

See the Thread FG has linked to for what they may try if they elect to try this one on.

 

However, I think you should write back, mainly to add a letter to the chain that shows what nonsense this bunch are spouting.

 

 

  • This would be Small Claims Track, so what costs did they have in mind (apart from minor ones such as Court fees)?

 

  • Likewise, what Statutory Interest did they have in mind (hint, s69 County Courts Act 1984 8% Interest cannot be claimed in respect of a Regulated Agreement, although Amex always tried to claim this in the hope that nobody will notice)!

 

  • The list of Threats is a breach of the OFT Debt Collection Guidelines, because they are clearly trying to say they will be in a position to carry these out after Judgment, forgetting the minor issue that you would first have to lose the case, then be in default of that Judgment before any of these Threats could be considered.

 

If nothing else, this will show the enemy in a very bad light if and when they decide to try their luck against you in Court.

How did you get on with the letter Davy ? My two are now with moorcroft so I,ve just written to them explaining about Amex non supply of my cca ,interesting to see what they reply with !

 

Didn't get much back to be honest. And i am on auto pilot regarding DCA rubbish these days.. i hardly bother to even file or read the stuff. If it's from a DCA i just bin it/ignore it. :)
