I recently wrote a letter for someone in my family requesting the true signed copy of the credit agreement under CPR rules, cant remember which points, it was a template letter from on here, because they were only sending the terms and conditions for our CCA 1974 request.

 

I think the thread was why not to send a CCA request under CCA 1974, if we wanted to challenge the agreement.

 

The creditor responded by saying that they wer not obliged to comply with my request because neither party has taken action.

 

How do we know if we should petition the court to a rights of all parties to the agreement?
