For those following the thread;

Heres the text that accompanied the uploaded doc.

 

"Here's my agreement, with prescribed terms perhaps conveniently squeezed on the side. Form has a 2 different serial numbers on each page side for 1999. Account sold to Link without a default notice being sent. LOA from MBNA said they had sold to Link on 1st May 2005.

Link then issued a default 4 years later. Default Notice from Link said it related to an account they were assigned (bought) from MBNA on 12th May 2005 which doesn't match the LOA from MBNA. And the amount is also wrong.

 

Only way to find out would be to see original document in a court case. Would MBNA release an original document to a Link agency lawyer hired for the day to present in a court case??"

Hello fellow caggers hope you have all had a good Easter break.

Well I have finally recieved my reply from my harrasment/doorstep caller letter, any comments welcome. I still have'nt recieved my cca sent second letter (not surprised!) Also I don't know if this has any relevance but my husbands name on his card and on all correspondance is spelt incorrectly with a h added and have asked them to remove this on a few occassions (before all this started)

The letters you had are only standard template letters MBNA send out.

I've received the exact same letters, if you've asked them to communicate in writing that's what they ned to do.

Remember your the one in control of this situation not them.

:eek: Blimey - that just confirms what I've always thought! I've given a bit of 'short and sharp' back though - No.....No.......No........No........standard answer to all their payment grabbing calls :D I want my SAR first......

 

It's quite comfy in this boat...all together !!! :grin:

 

I'm waiting for my SAR from MBNA and am getting phone calls and texts regularly from RMA. Isn't that reject button useful, second only to the delete button. :cool:

 

No CCA of course :roll:

I find it quite amusing really, MBNA keep sending me letters urging me to contact them urgently and quote an account number, so I write to them asking for CCA and SAR, and they send me stuff for an entirely different account.

Also note that they've started using telephone's which show up as 'private' numbers so you don't know it's them, and you can't prove how many times they've called because there is no number shown.

Guys, MBNA have sold one of my debts to a company called Direct Legal.

 

Firstly, has anyone heard of these?

 

Secondly, they've sold before the date shown on the default notice. What are the implications of this?

Is this DLC or Direct Legal and Collections?

I have had many dealings with them, though can't advise on implications of assignment date sorry.

I honestly don't know A+.

 

It just says Direct Legal - Dtl and they are based in Northants...very convenient for the bulk processing court I guess!!

Are they allowed to pass to a debt collector before they have issued a default notice? Had a very aggressive scottish lady call me from MBNA the other night and said that the debt will be sold on in two months if I don't pay. She told me how much was outstanding without going through any security. When I mentioned that she said I was being difficult and was I going to pay up or not? I said errrmmmmmmmmmmm NOT

Yes, MBNA done the same thing to me sold the dept on before the remedy date. I think they call it C..ked up big time, they can't sell the dept on before the remedy date has expired as it makes the DN invalid.

My MBNA is at the Court Stage, MBNA decided to sell my dept on to CL Finance ltd. At the moment court papers have been issued, but no reply to my defence to this point in time.

This is great stuff.

 

I have been wondering for a while whether there is a cut off date for compliant CCAs for the various companies.

 

AS I have been banging on recently about there must have been a decision made at some point that "we will not store these CCAs as no one will ever ask for them and we can save sixpence a year" a decision which has returned to bite them on the butt.

 

If that was the case we should, by analysing the responses, be able to say eg any agreement before xxxxx date will not have a CCA those from xxxxxx date will have a crap one etc.

The other scenario is many banks are quite happy to have the copy Agreement issue to hide behind, because it has saved them from having to produce the original documents that were flawed.

 

I'm sure many banks could not buy Scanners and Shredders fast enough, as it got them out of a corner.

 

Their next trick was to target as many pro-bank Judges as possible to get them to agree that a crabby copy of an Application Form, when added to another handy copy of some Prescribed Terms plucked as it by magic from somewhere else, somehow goes pop and makes an Agreement (where a binding one never existed before).

 

I'm sure the banks were delighted to be given this opportunity.

 

Our task is to rubbish this nonsense, and keep challenging crabby copies of Application Forms when presented with dubious copies of Terms, especially where the bank cannot offer any explanation where these copies came from, when scanned, when destroyed, when archived, signatures, dates, you know, the sort of evidence that any sensible business maintains...evidence that the banks feel is somehow beneath them.

I am minded to have a go back at them as I currently have nothing to lose.

 

MBNA have not responded to CCA requests nor have Barclayshark.

 

Crapone are calling me sometimes 5 times a day and I still have not passed security. Ellis will be receiving a stiff letter in the next few days!

 

Please keep an eye open as I will need technical support but fell more than confident to discuss my situation with a DJ
