This is my first post so hope it is in the right place. I am hoping for some advice on a matter concerning the catalogue Marshall Ward. Around 3 years ago I ordered a cupboard for around £140. It was not suitable so I returned it (it was collected) and had the necessary paperwork signed at the time. Shortly after this Marshall Ward sent me a letter to say they had changed my account number (apparently they changed everyones) and on this statement it also said that I still owed £140 for the returned item. I telephoned them butcan't remember the conversation as it was a few years ago.

I have now received a letter from Pheonix recoveries and Mackenzie Hall asking for £140. I absolutely do not owe this money but do not have the paperwork as I have since moved address. This company would also have had to track me down as I have had no communication from them for a few years.

Having read various posts I can see that I should ask for a subject access request so that I can see all statemnts for both of the account numbers. Please could someone advise me if this is the correct course of action?

Yes sending a SAR should confirm you've paid for the item, you could save yourself £10, by sending Pheonix and Mac Hall the 'prove it' letter..........

Account no:

 

You have contacted me/us regarding the account with the above reference number, which you claim is owed by myself/ourselves.

 

I/we would point out that I/we have no knowledge of any such debt being owed to (insert company name).

 

I am/we are familiar with the Office of Fair Trading Debt Collection Guidance which states that it unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

 

I/we would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

 

Furthermore ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

 

I/we would ask that no further contact be made concerning the above account unless you can provide evidence as to my/our liability for the debt in question.

 

I/we await your written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.

 

I/we look forward to your reply.
