Can someone give me advice about a well known finance house breaking the data protection act.

 

What happened is that i have got in some arrears with a secured loan. and the company could not get in touch with me(i had changed numbers and been working away). They sent someone to my home address to trace me. When they spoke to my neighbor and informed them that i was in arrears and needed to contact them asap.

 

I have put in a complaint and not heard anything for two weeks. what should i do now?

Hi this as you are aware from your post is a breach of DPA I would not bother complaining to company I would make a complaint straight to Information Commissioners office also try to get a statement from neighbour at old address to support this.

Thanks for the quick reply dpick, My neighbour said he did not want to get into any legal issues about this. After i told him i was really upset by this and would be taking it further. I might be able to get a statement from him. I will try

Don't be too hopeful about the Information Commissioner actually doing something.

My wife complained to them about HBOS not providing a DSAR on time (they are more than six months late). This sat in the IC's queue for a couple of months and then she received a letter saying that HBOS had told the IC they were going to comply and consequently the IC was closing the case. So that's alright then.

 

I would like to get pulled up for speeding and see what happens when I say 'I'm going to comply'.

 

In fact HBOS still haven't complied. Quelle surprise!

I really do appreciate all those 'thank you' emails - I'm glad I've been able to help. Apologies if I haven't acknowledged all of them.

Are you after compensation or do you actually want to ensure the company learns by its mistake and takes appropriate action? The latter I hope.

 

On the basis of what you have reported, then it seems the organisation is in breach of the DPA, the OFT Guidance on Debt Collection and possibly Section 40 of the Administration of Justice Act.

 

Happy to advise if you are not motivated by compensation.
