Yes I've opened another bank account today - Also I pay a debt recover group called 'Moorcroft' 50 PCM. They sent me a letter just yesterday increasing the amount to 77. I havent contacted them yet and they don't know about my change in circumstance.

 

- Want to come out of the trade - giving me too many grey hairs - lol. And I'm too young for that. Thinking about joining the police.

What was the debt with Moorcroft for? Wonder whether it would be worth sending the letter above to them too? It's a bit **** them upping the monthly payment unilaterally like that; can they do this?

Well, they can't collect what you now haven't got! I'd be sending them a CCA letter myself, I can't imagine they'll hold an enforceable credit agreement if it's been runnning a few years. It'll only cost you a quid to find out, anyway.

I am paying back a credit card debt (Egg) to a company called the Moorcroft Group who bought the debt. I've made regular payment for 3 years and I owe around 1k now.

 

I lost my job and am getting JSA of 60pw paid every 2 weeks.

 

My current agreement asks me to pay £77 PCM which I now can't afford - I rang to tell them and they've asked me to submit a list of my ingoings and outgoing.

 

Any advice? Does anyone have a form as an example of what I fill in. I rekon I can afford about £20 PCM until I am back in work.

I think it might be a good idea to fill in a I & E form to justify why at least you are showing to be communicating with them...however did you ever claim any excessive penalty charges that have been added to the account ?

If they want this information (even though they are not legally entitled to it) then its up to them to provide you with an i & e form & well as a business reply letter, so as there is no cost to you when you reply.

On the i & e form..you must put down what you spend on food,clothes,travel costs,water,gas,elec,tv license....being on JSA there is bound to be not much left..so you just put down as your offer £0.00 and there will be nothing they can do about that :)

I sent them a CCA - got this back - typed up by myself - no scanner - dated August 18.

We duly confirm that we have requested the relevant documentation from our client (huh? was under the impression they purchased the credit card debt from Egg years ago?).

 

Meanwhile, we duly confirm that all collection activiity on the account has been put on hold and we will not seek to enforce payment of this debt until such time as the documentation has been supplied or we have advised you to the contary. (now because I am out of work I have been paying them back £20 pcm and the next payment is due out tomorrow, should I cancel the debit or wait and see if they take it?)

 

In the meantime, however, we believe that it may be of assistance to all parties if we also take this opportunity to ensure that any potential areas of dispute are addressed prior to any possible court action or further investigation.

 

To this end can you provide an indication of the information you will be relying upon, when giving evidence to the court or information to the relevant authorities in relation to the alleged subject matter of this account.

Well they do say in their missive that all collection activity on the a/c has been put on hold & collecting payment is an a 'collection activity'. ;)

What on earth are they blabbing about? They're effectively asking what info you would rely on in court without resorting to CPR - have they previously threatened legal action, or have you? As if you'd show your hand early...

 

All you're really asking is whether or not they have a CCA, as is your right, and therefore whether the account is enforceable or not.

 

I don't understand what they mean by 'alleged subject matter'. Has there been any other correspondence? Or are they on hallucinogenics?

I ignored moorcroft - it gets sent to other debt collection agencies and never goes away - you do get time inbetween though - eventually it goes to an agency that threatens court action.........usually a micky mouse solicitor....that accepted an agreement on CCJ day from me. Moorcroft forget them.

Moorcroft are definitely the bootom feeders of the DCA world. Their letters they send out are laughable, got enough threats from them over the years to paper our living room.

 

I did write back once asking if they could use softer paper for their letters so I could use them for what they're worth :D

if you make a payment then the 6 years start again, it is 6 years from last payment or written acknowldgement

UPDATE:

 

Letter from Moorcroft today returning my £1 and asking me to write to Egg directly to request a CCA.

 

Any thoughts on course of action. - delay tactics?

 

I had believed up until last month that Moorcroft had purchasded the debt.

 

This is for a £4k credfit card debt w/ £900 remaining and they recently offered a settlement of £600.

 

If they don't have a CCA I don't want to pay them anything as the remaining debt is basically interest and charges.
