Thanks PF - I may try writing to them as well as see if they are prepared to 'name and shame' the figures on a particular company I am after - if they are going to publish it anyway you would think they could have no reason to refuse this

It would be so interesting to get all sorts of stats from the FOS but as it is a private arrangement within the finance industry, the FOI doesn't apply.

Write to them and ask them but it will be interesting to see how - if at all they justify their refusal

 

In light of the present PPI reclaim and credit meldown I believe the FOS are more than happy to present figures on their performance.

My guess is there will be a rather large increase in the figures released next year on PPI mis-selling. That is if the credit crunch does not deplete the staff numbers employed by the FOS which must have surely increased dramatically looking at the link above.

 

Point here is keep up the pressure and if the FOS need more recruits to get results then so be it. PPI reclaiming successes through the FOS are definately increasing but the time scale is still wearing folks down.

Halifax - Full settlement incl interest.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

 

PPI Claims ongoing with:

Cap one Now with the FOS

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.

LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

 

1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

89% claims currently being upheld - yikes!!

 

Thanks AA - I bypassed FOS purely because of the time scales but unfortunately small claims is quite scary to someone like me so I'm trying to get all my reasearch in before my court date and would just like to give the judge a little reminder about some figures for these dodgy policies and thought you can't really argue with the FOS figures.

 

I'm gonna get in touch with them tommorow and ask for figures on the rascal of a company and see what they say.

I was wondering if anyone had links or information on the number of single premium PPI cases the FOS upheld in the years 2006-7 2007-8 2008-9??

 

Also does anyone know if it is possible to ascertain % figures for individual companies they have upheld??

Hi Tracey - I'm due back in court with them in August but I am also taking another case of action against them to - not just PPI now - they have narked me off so I'm going after them for something else as well that could see them having to pay SUBSTANTIAL damages if they don't buck up their ideas.

 

I can't really say what it is at the moment as walls have ears and forums have unwelcome eyes but as soon as it's done I will spill all - promise

Just to let you know if you take legal action for anything, even if the claim is below £5k in value, and allocated to the small claims track, you can risk costs against you if you lose, under CPR 27.14[2][g].

 

I seriously suggest that before taking any claims for damages against Welcome you get relevant legal advice.

FOS tell me they are aiming to name and shame in September and I asked them if I could have the figures on the institution I wanted and they said they didn't think that would be possible until they are officially published but told me to put my request in writing.

 

I have done so and got a response saying my query was being looked in to - nothing further since.

Any official response on this must surely merit an immediate post in very large letters :eek:

Quick question and I hope you will forgive me being a little cryptic but I knwo the company I am dealing with trawls this site so I am being a little careful.

 

I have in my posession 2 documents that detail something that said company should have declared when I made an agreement with them.

 

The 2 documents I have do not relate to me or my agreement but they go to prove something that I allege in my POC. These have been provided to me by 2 different people and in no way are they marked private and confidential without prejudice or anything along these lines.

 

Would I be able to use these documents in court?

 

Sorry - if this is too cryptic I will try and rephrase :D

I'd say YES !!! and that money is yours.....it potentially taints the contract too if it is a 'secret' commission....!!! It should have been disclosed as part of a multiple agreement...!!

I well aware of this and so far said company have aluded in a previous court hearing that they know i want it but won't comply - the judge has said basically wait til your full hearing and then raise it then with the fact they have failed to comply to my request. I have 2 written proofs of this and 1 recorded phone conversation with the 'middle man' confirming that commisions are paid but could not disclose amounts as they said this was an arrangement between the 2 companies.

 

We are at the stage of having to send each other the docs we intend to use - should I just pop them in their - I believe I do not have to explain their presence

nope - one woman on her crusade after being called a stupid little girl!!

 

This started as a general PPI reclaim but seems to have snowballed as I have found a number of 'issues' I feel need to be dealt with in the best interests of all concerned ;)

Hi

 

I am the CLAIMANT in an action to recover mis-sold PPI I am trying to get my hands on documents that I would normally get under a SAR - bascially everything they have on me.

 

However the company involved is not really playing ball and to be honest is flat out ignoring me - they are not cashing the postal orders and are claiming to not be receiving the SAR (i have sent 2 now) or reminders despite them being signed for.

 

Now I believe (correct me if I'm wrong) that I can get all of this under CPR however the template letter I can find is one as if I am the defendant.

 

Does anyone have a claimants version??

you can change the template to say you are a calimant, under the rules any information which can he helpful to your claim they have to disclose.
