      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I don't see why not, a judge can only say no....as for the misselling of the PPI, then you would need to start a dispute directly with them first, then you can either complain to the FOS or FLA, OFT, FSA.....OR take them to court....as for the non compliance witrh the SAR, then i'd definitely take them to court for that - OR issue a CPR31.16 - some useful threads here

Thank you for the advice about the interest. Will defo go for the highest first, methinks!

 

With regard to the PPI, I have been advised on another thread regarding Swift that the refund of PPI would come from the insurers themselves, so there seems to be a bit of confusion here as to who to approach for this:confused:

 

I am going to send off a non-compliance letter and will see if anything comes back both re: underwriting sheet and the PPI policy, but it would be useful to know whether I should be thinking of approaching the insurer (who's paperwork we still have) about this.

 

Trouble is, there was obviously - I presume - a partial refund of the PPI included in the redemption figure, but at this stage I have absolutely no idea how much it was and have a feeling it's going to be hard to find this out:(

The misselling of the PPI is the responsibility jointly between the broker and the loan company.....if it has been missold then it will be the broker who originally missold it to you, but Swift have a a joint responsibility for this too especially as there are backhanders involved...!!!

 

Trying to get them to own up and take responsibility will be the interesting bit I think:eek:

Just updating this thread -

 

Well the 8 weeks for the investigation into our PPI is just about up, but as I've noticed that the mail we get from Swift/broker seems to take a week from the date it was written to the date they post it, I'm going to give it a few extra days - generous of me eh?

 

If we still haven't received anything/anything positive I'll be firing off a FOS complaint to add to the many for LTSB I'm currently filing:eek:

Hi Landy,

I have recently spoken to the FOS - see the thread I started recently about Swift.

The chap I spoke to was reasonably helpful, and when I asked him about regulated/unregulated loans his words were 'Its a grey area' which, with respect to him, did not help too much.

He has however agreed to write to Swift regarding the early settlement figure, a copy of which I received in the post today.

As soon as I get a response I shall post it.

I just have feeling that no-one is going to take responsibility for these unregulated loans - it seems crazy that a loan for under £25,000 has more protection for the consumer than one over it:eek:

 

I know the rules regarding regulated/unregulated has now changed but that is no comfort for those who have already been caught out on this.

Hi All,

 

I am still not sure what difference it will make if my loan+futher advance is deemed regulated by the CCA '74 or not - can someone clarify that please?

As I mentioned in my other thread, my origianal loan was regulated by the CCA 74 but the new loan I took out a few months later had at the top "'Agreement modifying a credit agreement and regulated by CCA1974' so even though my total borrowing was £27,500 is it still regulated and if the answer to that is yes, is there anything I can actually do regarding this brutally unfair situation?

Just updating this thread -

 

I contacted the FOS to see whether they would be able to investigate the charges issue on our Swift mortgage and the answer was 'no'.

 

The FOS said that -

 

'We would be unable to investigate this issue as it is in relation to a consumer credit agreement which was taken out prior to 6th April 2007.

 

Consumer credit only fell within the jurisdiction of the FOS as of that date and anything prior to that date I'm afraid we would be unable to investigate.'

 

So there you have it - no go with the FOS on this one:(

Hi Guys,

 

I have a secured loan with Swift, also I have PPI, however I had to claim on my PPI due to a lenghty recuperation from surgery.

But can I still claim back any charges against Swift because I am in arrears with them I am getting hit for some pretty hefty charges.

Hi everyone:)

 

Has anyone tried using the FLA to get charges back from Swift or are they a pointless waste of time?

 

They have an online complaints form, but there is no mention of printing it off and sending it to them accompanied by supporting evidence as you can do with the FOS.

 

I have an absolute mountain of supporting evidence and without having that I don't see how the FLA could be of any use:-?

Well having heard various tales of how the FLA are as much use a chocolate sunglasses, I don't think I'm going to bother going down that route.

 

Once a few of our mis-sold PPI refunds start coming through I will be filing at court (and making a donation to the wonderful CAG, of course!)

Another problem complaining to the FLA is that it takes up time during the 6 months your aloud to complain to the FOS - if you are elligible of course to do so and I know not everyone can. Hi Sparkle72, see you're currently "active" - have you uploaded your documents?

[EDIT] ( commission means paid agents) and their company accounts also say they do, over £19 million worth plus the fact that it has been declared under oath that they do not....would this not be considered by the Courts as more of a "Disguised Secret Commission"? Which is even worse

 

And as per Wilson v Hurstanger and Wilson v First Counties Trust would not folks agree those peoples agreements would be considerd unenforceale.
