not sure if the original loan was enforceable as they added the amount of credit to the ppi to give a total amount of credit i was paying interest on the ppi

 

 

think you may be a little confused - there is nothing wrong with paying intrest on PPI as long as they have showed this on your agreement - it's intrest on acceptance fee if they have not declared thats a no no

sorry i did mean on the old agreement its got acceptance fee 235.00,mortgage indemnity fee 1858.85 total charges other than interest 2093.85 total amount of loan 21615.61

havent been on for a while as things ad settled down and am still waiting for fos who are still investigating.however today received default notice even though account is indispute askinf for arrears to bw paid in 14 days,if not they will pursue for an attachment of earnings or pursue the surety what is the surety and where do i stand if the account is in dispute?

As there is no benefit to the repossession ie Mortgage company (1st charge) would have to be settled first and as negative equity, they would have outstanding balance and therefore Welcome would be due to naff all, no way is any authority going to sanction re-po. It is important however, that you remain arrears free on the mortgage.

For peace of mind, you may want to ring mortgage co and ask them to confirm they are happy with your current position.
