    • If you have legal cover and insurance, you can try going ahead with your Insurer. They may be able to refer you to their "Legal Partner" but do your research.  If you know where 3 of them live, you can attempt to take them to court, but in todays climate, going legal will not get you the result of £15k that you are after.    Others may have their own input - But in reality you are asking for £5k from each of them - Might find it hard to recover that in a timely manner.  Like I said earlier - Your option maybe to take the hit now and factor it in to future tenancies.
    • I have insurance that covers legal matters for this property, and I can confirm it with the insurance company. I also know where the tenants currently live, as all three have moved to the same place. There's been a lot of mold growing in the property over the past few months. All the builders who came to look at it think the mold grew because the windows were kept closed, lack of heating. In the past few months, they haven't used much gas or electricity, as shown by the smart meter I checked. Recent trace and access report says there's no water leak in the property. I have lots of photos from when I moved in until now. But in court, more people usually want to sue the landlord, not the other way around.
    • simply write to them, offering one months fee, give them 14 days to accept. if they sont accept, ignore everyone. Harlands too! and the extra £20 penalty is not allowed either. thread title updated. dx
    • So technically you could push it via the courts with the clause in the AST (I remember seeing something about this recently)  However if one has left the country - It might make it hard to recover it all from the others.    How would you look to bring action against all parties involved? Do you know where all of them currently are?  You can service to last known address but as you know they have moved on - It could be held against you by a judge if it goes all the way.    I think you need to consult a solicitor on this one - Its a complex claim against multiple people rather than a simple Creditor vs Debtor claim we see here.
    • Initially, the property was let to four foreign students, but they are no longer on student visas. During midterm, two of them moved out, and two new friends of theirs moved in, one of whom is the lead tenant's British girlfriend. The lead tenant got married to a her and became a dependent who is now one of the tenants in the AST agreement. The third tenant found a work permit visa, and the fourth left the country a few months ago. Recent contract only three.  Please see the attached AST, which seems that I may be able to claim any costs exceeding the deposit. All ASTs were signed electronically using the MUDHUT template. • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I went through the whole Champix course, being 2 people and could kill one minute and love the next. When I finished the course, weight flew on even though I wasnt eating. My temper was vile and all I could think of was throwing a rope round my neck. Have been off it for 5 months and still have feelings of doing something daft.

Maybe just me but as a general calm easy going person who wouldn't hurt a fly, is really strange behaviour. Please be careful

'StinkyFeet'

I concur... Champix is VERY dangerous to some people! I was on it for approx 7 days a few months ago. I ain't ever had experiences like that before!!! I was angry, disorientated, QUICK tempered, unable to sleep, unable to relax, sick, depressed, suicidal, hyper-active...

Virtually EVERY psychological issue known to man was inflicted on me during those fateful few days. I am still suffering with 'grinding' my teeth in my sleep to such an extent that my 'better' half has to physically roll me over or punch me to stop it!

I now have the 'inhillators' which I am going to try... :)

Re..Champix

Last March partner was advised to stop smoking due to health probs, so said right we'd both go for it.

We both started the course, abso brilliant, stopped on the designated day and we were both great, no craving or anything. However I went through a few of the symtoms stated on the leaflet, night sweats, dreams, headaches, heart going potty at times, (had a heart monitor at doc's) but still perservered.

4 wks into the course, I noticed my left foot was very red and itchy, it didn't bother me to much, but 3 days later I started getting blisters and the skin on my foot started shredding...ekkk (won't go into the gory details). Went to the doc's, was advised to stop the tablets straight away. I ended up with a rash all over the left side of my body and the skin on my feet and hands came off. I ended up at the hospital.

A year later I'm still hving probs and still visiting the hospital. So, Yes, I do think Champix is dangerous and need to be monitored very closely.

However on the bright side, we're still not smoking, I can actually stand beside someone smoking and quite like the smell, but can't stand the smell of it on someone's clothes or breath, makes me feel quite sick.

But would I do it again, no, not after what I suffered, but partner never got any symptoms at all.

Hi weedalli, sorry to hear about the problems you had. You seem to be one of the unfortunate few whose body doesn't like champix. Of course, what suits one doesn't necessarily suit another. Most people seem to be OK with it.

A drug that I have problems with is allopurinol (for gout). I get a rash and my skin feels hot and intensely itchy, especially my scalp, face, neck and shoulders. As a result I had to stop taking them. Now, when I have an attack of gout, which usually lasts two or three weeks, I just have to rely on massive amounts of pain-killers.:(

If this has been useful to you, please click on the scales at bottom left of post. Thanks.

Yes Rooster, your right, I'm the one in a million who they print the leaflet for.

Champix is good, I know loads of peeps who have taken it with no side effects and have stopped. Even thought I had those probs it did help me and I'm glad I don't smoke anymore. :)

  • 1 month later...

My wife has been on champix for about 2 months. The stopping smoking part has been great and the pills do their job exceptionally. But!! It's like being married to a different person. Her personality has completely changed.

A few days ago she decided to come off the pills and within 48 hours she was vomiting.. spinning.. panic attacks. Finally she shut herself away in a room just holding her head.

She immediately went back on the pills and the symptoms stopped a few hours later.

Coincidence? we'll see in 4 weeks when the pills run out :(
