Hello everyone,

recently my boyfriend moved in with me and he unfortunately came with a few debts to his name. The flat is mine and so all the valuables in it (TV, computer etc.)

Bailiff turned up looking for him and wanted to make a list of all valuables in my flat and gave him a week to pay or else he'll come back and take my things.

I told him that as the debt is not mine and i can proove the items belong to me he has no right to do so. He said that as my boyfirnd lives in the property anything valuable that can be sold to pay the debts will be taken.

anyone can shed some light? Could my stuff be taken to pay off the debt?

Send them a special delivery letter.

 

make it clear that the property is yours and that the property within is yours.

If they visit again, you should record what is said or else make notes as you go along.

I suggest that you answer any knocks at the door with a chain in place in ordr to avoid any "misunderstanding" that they were given entry.

 

You shoud also check your credit file. these things have a knack of spreading and getting out of hand.

 

The best they can use your address for is to serve a court claim to addressed to your BF.

If I was you I would get a statutory declaration sworn at you local county court stating that the goods in the property belong to you.

 

You can then use this as evidence to show the bailiffs they are your goods and they cannot take them.

A Statutory Declaration is like an insurance policy for you in that it provides the security of your goods.

 

I have posted a template one here a few times which I think you should find under ConsumerWiKi. If you cant find one, please post back her and I will post another.

 

Sorry, I should have mentioned. I bailiff CANNOT take your goods. He can ONLY take goods that belong to the debtor.

Hi.

 

I've been reading this thread with interest.

 

The Statutory Declaration letter, where do you send this for it to be approved/stamped?

 

Can you simply send it to your local court house along with the £5.00 fee and they will approve it?

 

Or do you physically need to goto the court?
