    • Okay please go through the disclosure very carefully. I suggest that you use the technique broadly in line with the advice we give on preparing your court bundle. You want to know what is there – but also very importantly you want to know what is not there. For instance, the email that they said they sent you before responding to the SAR – did you see that? Is there any trace of of the phone call that you made to the woman who didn't know anything about SAR's? On what basis was the £50 sent to you? Was it unilateral or did they offer it and you accepted it on some condition? When did they send you this £50 cheque? Have you banked it? Also, I think that we need to start understanding what you have lost here. Have you lost any money – and if so how much? Send the SAR to your bank as advised above

    • In the SAR, I received the original application, lots of computer print outs, yearly statements from 2013 and the new emails regarding my complaint. They sent me a £50 cheque after I chased them for the SAR after the 30 days. They said they was waiting for me to respond to an email (which I never received) before sending the SAR

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

thanks for the help

 

ill post the DPA letter today but i got another problem

i received my original credit agreement today and in the smallest ink there is a box with payment insurance ticked

 

now i know for a fact i NEVER agreed to that

i NEVER take insurance out on credit or mobile phones or what ever

 

what are my rights on this?

 

i calculate they have take around £1080 over the years

i am fighting HFC/Beneficial on 2 fronts

 

first is for a refund of Charges and the other is for miss-sold PPI

 

thanks to a template from robert_harper_2000 ive made this letter

 

COMPLAINT

 

Dear Sir or Madam,

I took out a loan with you for £xxxx on xx/xx/xx When I took it out, I signed up for Credit Protection Insurance

 

I work part time and therefore will not be eligible for any payments from the Credit Protection Insurance if I cannot get work or am sick. My situation was known to the person who sold me the loan, however he did not point out that the insurance was virtually useless to me so I think that I have been miss-sold the insurance.

 

I have been advised that I should be able to cancel the Credit Protection Insurance contract at any time and receive a full refund of the premium that I have paid.

 

And in view of the way I was miss-sold the insurance, I would like to ask for a full refund of the whole premium currently £xxxx

 

I would appreciate a reply to this letter within fourteen days. If you reject this complaint, I would be grateful if you could explain whether you provide an internal appeals process. If you do not, please supply me with a final response letter, so that I can take up the matter with the Financial Ombudsman Service.

the time is up on the lba and I'm about to start a claim but i'm not sure on which name and which address i should serve proceedings to

 

when i first signed up for the loan they where called HFC Bank but now i get statements from Beneficial Finance

 

which name do i put and what address do i serve to?

filed a claim against Beneficial for the admin fees and it was served on the 18th of Oct and the 14 days for them to respond is up tomorrow and i haven't heard a single thing from them

in all the other threads Ive read normaly people would have received a letter from Clare Plummer or someone

 

i served the claim against the registered Beneficial office that appears on my statements

Hello all!

I am new to this forum, and came accross it whilst searching the net for other consumers like me who are sick of being taken advantage of by their banks...

I, like many here, initially came into business with Beneficial Finance about 5 years ago when buying a laptop at PC World. It was the biggest mistake of my life.

I am still with them, stupidly having accepted numerous offers for loan extensions over the years, at ridiculous rates of interest. However, my first loan with them was finally settled 6 months ago now. I was working full time until then, and so the insurance was apparently valid - however, on several occasions I stated that I didn't want the extra PPI, but was told it was compulsory as I was a 'high risk' customer.

I would, though, like to know exactly what rights I have enabling me to claim back fees etc from them for that first loan???

I am in the process of paying back my second loan with them, at only half my agreed monthly payments due to a drastic change in circumstances. I believe I am still paying PPI for this one too, despite the fact I am only able to work part time now. In truth, while this second loan continues, I would REALLY like to keep them off my back (they've absolutely plagued me and my family with phone calls). Would I be able to take action on re-claiming fees etc on this second loan after the loan has finished?

You need to look at the ppi section on this website, it is on the first page. Read the different posts and get information from other peoples experiences, get the condifence for the battle that will start with your first letter. They are just like the bank charges, they will never admit to it,:lol: but who cares as long as you get what is rightfully yours

 

Just start a new thread for advise and information relating to the mis-selling and claiming of the dreadful ppi.

 

Regardless of whether you are paying only a percentage of the ? loan/debt, you are still within your legal rights to reclaim it back plus the interest:D Just remember there are more ways to skin a cat (yuk):eek: Good things come to those that wait.

 

I will keep a lookout for your over on the ppi section :-D

PPI is entirely optional with Beneficial Finance. If anyone told you it was compulsory, I am afraid they lied to you. I used to work for Beneficial and this practice is not uncommon.

 

Unfortunately, Beneficial Finance (which is a trading name of HFC Bank Ltd, which in turn is a division of HSBC) is a highly incentivised sales force. They were targetted to sell PPI to 85% or more of their customers. High pressure + big incentives = non-compliant sales practices.

 

Beneficial Finance is regulated by the Financial Services Authority (FSA). One of their statutory objectives is to provide adequate protection and redress for consumers and they do this through the Financial Ombudsman Service (FOS).

 

In the first instance, you should make a "Subject Access Request" for all the information they hold about you. You will need to send them a cheque for £10 for this. In particular, you want a copy of the branch file that shows how they established that the PPI policy was suitable for you.

 

Then you should make a formal complaint to the bank. If they are unable to resolve your complaint within 8 weeks (by refunding your PPI), you have the right to take your complaint to the FOS for adjudication.

 

Insisting that a policy is compulsory when it is not, is technically a fraudulent claim. Proving that will be the hard bit.

 

If you make a fresh post in the PPI or HFC Household section, I'll do whatever I can to help.

Yes, but treat the PPI and charges separately.

 

You can address them on the same letter, but treat them as two different complaints. Charges are being contested over their legality and as yet, no bank wants to be the first to go to court.

 

PPI is being contested as it has often been miss-sold. The legality of the cost of PPI is not however in question. Whether the policy was appropriate for you and whether you were given all the information about it (including costs) in order to make an informed choice, is another question.

Review your loan documentation and see if this cash back offer is detailed in there. I doubt you'll find anything to be honest.

 

If there isn't, you should make a formal complaint to the branch where you took the loan - maybe go back and see the Branch Manager or Customer Account Manager who sold you the loan and the PPI.

 

Again, if they have made a false claim about a policy, they are in breach of the FSA's Principles for Businesses along with about every rule in the book.

 

Use their complaints process and then take your complaint to the Financial Ombudsman Service if you are still not happy. You could even consider making a complaint to your local Trading Standards Office. HFC Bank are regulated by the Office of Fair Trading as well as the Financial Services Authority. i just not have started the thread because i'm waiting for my loan documents who i have passed to one brocker(shark)who promise me to found a better deal for me with b.finance i have complained to the onbudsman about that shark to receive my docs back but i promise you a soon as i have them back i start the thread thanks anyway

I have a question please. My partner purchased a TV from Currys in 2005 which he was given finance for through Beneficial Finance. He did the deal in the shop and signed for the loan and the monthly direct debit payments. There was never any mention on PPI plan. Shortly afterwards, he was sent a credit card from B.F and called in to see them for a 'check up' to see what else they could do for him. The gave him credit up to the value of £3K. I do not recall him signing up for any PPI as I was even there at the time during his meeting.

 

Now we are facing some financial difficulty which has been brought through wrong tax codes causing his wages to be a lot less than they should be so he has been spending on his card. The other day he received a call from B.F saying that his payment had been received, and then reversed due to lack of funds I assume.

 

He is still paying ppi on the loan which I can honestly say, I don't remember him getting. I say this because I don't condone such things.

 

I am a little confused as to what to do because he called B.F and they said that they have frozen every single Beneficial Finance credit card in the UK and no one can spend on them at the moment.

 

They never actually asked him to pay his monthly balance over the phone.

 

He has since received a statement saying they want nearly £200.

 

What should I do?
