1.) :confused:Hello the good people of these forums, here is my story, :confused:

 

I requested loan agreement from "Lowell" concerning some egg account i had 4 years ago, i requested it from the 8th December and received something on the 16th January.

 

i have attached the 3 documents , the documents are only one side nothing on the other side. furthermore they say this account was set to nill by egg in preparation of selling it to them. There is no statement of account so basically they are saying i owe £5996.00 with out a statement saying that. so how do i know how much i apparently owe? and if there are any illegal charges on that account that i can dispute? or weather i owe anything at all?

 

can any one help point me to any information or any letters i can forward to them to basically say fcuk off.:confused: its a "loan" by the way not credit card

2.) When going bankrupt, where it says on the form "list creditors" do i list my original creditors or the debt collectors who have bought the debt? i was just wondering, when i go bankrupt in the future thats if i do?? anyone know the answer to this?

I haven't been there myself but I would guess that you should put the original creditor's details together with a note that the DCA is acting for the OC.

I really do appreciate all those 'thank you' emails - I'm glad I've been able to help. Apologies if I haven't acknowledged all of them.

When you have been issued a court claim from a creditor, do you have to go into court or is it a paper hearing? silly question or if you don't not know point me in the write direction

You don't have to go to court but it is in your best interests to attend.

 

Have Lowell actually issued a court claim against you?

HAVE YOU BEEN TREATED UNFAIRLY BY CREDITORS OR DCA's?

 

BEWARE OF CLAIMS MANAGEMENT COMPANIES OFFERING TO WRITE OFF YOUR DEBTS.

Hello thanks for your reply. no court action as of yet but i have decided what ever happens, I will defend against any action they take. thank you for your reply.

 

Do you know weather my loan agreement is valid by the way?

You would need to know if the 2 agreements sent to you is front and back

Thanks for your reply, how would i know if there front or back it seems there just 2 pieces of paper separate, and a letter from Lowell asking for money.

 

has any one actually looked at the link i have provided? for information? hmm...

 

can anyone point me to any good letters basically saying 1.) they are in default of the account because i sent the request on the 8th December 2008 and got some fake agreement on the 16th of January 2009, it also states on there letter they wrote to me that the balance of the loan was nill but still want me to pay them money. which is on the link i have provided hmm maybe ill wait for the working week see who gets back to me. apart from that have a nice day.

Done a search on various egg agreements and they all seem to be the same and it looks as though the 2 agreements you have are front and back of the one page.

 

On the basis of the above the agreement would be enforceable.

 

If you want to get an exact breakdown of the account you would need to send a SAR
