    • lookinforinfo - many thanks for your reply. It would be very interesting to get the letter of discontinuance. The court receptionist said that the county court was in Gloucester 'today' so that makes me think that some days it is in Gloucester and some days its in Cheltenham, it was maybe changed by the courts and i was never informed, who knows if DCBL were or not. My costs were a gallon of petrol and £3.40 for parking. I certainly don't want to end up in court again that's for sure but never say never lol. Its utterly disgusting the way these crooks can legally treat motorists but that's the uk for you. I'm originally from Scotland so it's good that they are not enforceable there but they certainly still try to get money out of you. I have to admit i have lost count of the pcn's i have received in the last 2 yr and 4 months since coming to England for work, most of them stop bothering you on their own eventually, it was just this one that they took it all the way. Like i mentioned in my WS the the likes of Aldi and other companies can get them cancelled but Mcdonalds refused to help me despite me being a very good customer.   brassednecked - many thanks   honeybee - many thanks   nicky boy - many thanks

This is nothing about paying just for what I use - I currently prefer the averaged monthly payment - else i wouldn't be in credit month after month - which I am comfortable with - else I wold simply request a part refund - which I  would have done if they hadn't reduced my monthly dd after the complaint I raised (handled slowly and rather badly) highlighted the errors in their systems (one of which they do seem to have fixed) Are you not aware DD is always potentially variable? ah well, look it up - but my deal is a supposed to average the payments over a year, and i dont expect them to change payments (up or down) without my informed agreement ESPECIALLY when I'm in credit over winter.   You are happy with your smart meter - jolly for you I dont want one, dont have to have one  - so wont   I have a box that tells me my electricity usage - was free donkeys years ago and shows me everything I need to know just like a smart meter but doesnt need a smart meter,  and i can manually set my charges - so as a side effect - would show me if the charges from the supplier were mismatched. Doesn't tell me if the meters actually calibrated correctly - but neither does your smart meter. That all relies on a label and the competence of the testers - and the competence of any remote fiddling with the settings. You seem happy with that - thats fine. I'm not.    
    • Evening all,   So today, I was sent an updated offer that includes the £12.60 I spent on letters, but they have declined to add the interest at £7.40. They have stating 'We acknowledge your request to claim interest to date, however, this would be at the discretion of a trial judge if the claim did proceed to a trial hearing.' I think I am content with this outcome, and pushing this to a trial for a total interest of £15.30 throughout the claim does not make sense to me.   What are people's thoughts? I am sure our courts have better things to concentrate on?

    • Have to attend the hearing and present evidence of his financial position (income & expenditure) and  statements ,and agree an acceptable payment plan with the judges guidance.  It will be a form of redetermination hearing as already stated.The court will not agree to bailiffs if the financials do not reflect it or assetts are minimal. They just want to determine his true affordable disposable monthly figure....which will not be £10.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Please can somebody give me some advice?

I paid off a large barclaycard bill in Oct however the next bill I had showed an interest balance of £84. I rang Barclaycard and they apologised and said even though I had paid the whole bill off I still owed the interest which would show on the next bill. I was lucky enough to argue it and they removed the interest, or so I thought. The following month I recieved another bill with interest of £100 a late payment charge of £12 and a default as I missed a payment. I went mad and rang again after a lot of arguing and explaining they apologised again and promised to remove all charges, default and balance or so I thought!!. Along comes this months bill with yes you guessed more interest another late charge and another default. I rang again and spoke to another jobsworth and his manager and he also said he would remove everything. A couple of days ago I recieved a debt colection threatening letter for £10.00 arrears on a zero balance. I rang Barclaycard and my balance is now nil however I must pay £10.00 (Two months minium payments of £5.00) or the debt collection agency will be making a visit. Also they are asking for another £5 minium payment for January. The woman on the phone told me to ignore it. I rang Barclaycard a couple of hours ago and they say I still owe it. I paid £15 over the phone but need to know what to do about the incorrectly posted defaults and £15 which I had to pay just to stop the DCA calling. I have spent about £20 in phonecalls to Barclaycard in 4 months.

Hi Scarlet,

 

Have you checked your credit records to see if any defaults are actually showing.

 

You really need to know this to ensure you know what you want BC to remove from your history.

 

First off, I'd put your complaints in writing to BC giving a brief summary of events to date.

 

Tell them you require written confirmation that the a/c balance is showing as zero (or is there now a credit in your favour because of the pay'ts made). Or, if there's a credit on the a/c, tell them you require immediate repayment of this sum, together with compensation for all the stress and phone charges this has caused.

 

If there are any negative markers on your credit history, demand that they be removed immediately.

 

I don't think you should have paid the £15 by phone - however, it's done now. :)

I got worried so paid the £15 however just rang Barclaycard and automated service said I still owe £15. So spoke to an advisor who told me that card was in credit of £15 and ignore the automated service.

Still not sure who to believe. I had to consolidate this original card debt of 8K with a loan so I thought I would be able to sleep at night. Wrong!!!

 

Thanks for your advice I will write a letter this weekend.

I received a letter last week from Barclaycard. They have not apologised and they did not mention any defaults. They have just put £125 on my credit card. I have not used the card since I paid it off. They say it is the final response. What do I do now? How do I get them to remove the defaults. I have already threatened court action so could someone please tell me what I can do.

Hi Scarlet,

 

Have you checked your credit files to see if there are any Default or late pay't markers which should not be showing.

 

Have you rec'd a full refund of any penalty charges which were made.

 

You need to check your recent statements to see they've refunded all penalty chgs. If not, list them on a SOC and fire it of with a reclaim letter.

Hi Slick,

Yes the credit file shows that I missed two payments. There is no mention of default so I suppose it can't have defaulted. However I really need to clear that as technically I didn't owe anything therefore I never missed any payments. I have previously claimed for recharges which I got back in 2006 (about £100+) and they took off the last two late payment charges in the end. I have sent two letters asking for my credit file to be adjusted and they have ignored me and just offered me £125 as goodwill. What I would like to do now is take this to court but I don't know what the next stage is. I am not after any charges I just want this case to go further as it will effect my credit rating an I am studying to be an accountant. Any help is appreciated. thanks

Hi Scarlet,

 

I assume, from your reply, that all penalty charges have been refunded.

 

If your credit record shows that 2 pay'ts were missed by you or paid late, you need to take this up with BC and get the credit records corrected.

I have requested in writing twice for my credit file to be amended but they seem to think the £125 is sufficent and will not discuss the incorrect late payment marks against my name. Can I now file a N1?

They gave me the £125 just as a Goodwill gesture as in my letter I had told them how stressed I was with their error. However in their reply to me they said that they were crediting the credit card with the £125 but they did not mention my complaint or the bad credit they have put on my name. There is no bank charges involved in this case.

I think you should write one further letter to the CEO's office along the following lines:-

Dear Mr Varley,

FORMAL COMPLAINT

Account No: xxxx xxxx xxxx xxxx

I regret having to contact you but cannot get a reasonable response from your staff.

Last October, I paid off my BC account but, for some reason, incurred an interest charge the subsequent month. When I contacted BC about this, it was agreed the interest would be refunded.

Clearly this was not properly dealt with and my next statement showed further interest payable along with a late payment charge of £12. I again had to complain and was told it would all be sorted.

However, in January, after this was still not resolved, I was threatened with collections proceedings and agreed to pay £15 by phone to avoid further problems.

I then wrote to BC on xxth January setting out my grievances - a copy of this letter is enclosed.

I was offered £125 as a Goodwill Gesture but have been unable to get any reply regarding the removal of the late payment markers from my credit files.

I would like these negative markers removed from my credit files.

I fail to see why such a simple matter is so difficult to resolve. I should not have to endure the stress and inconvenience of trying repeatedly to explain all this to your your staff, only to have them ignore my reasonable requests.

I now require that the negative markers be removed within 14 days or I will start court proceedings to rectify this matter, without further notice.

Well I had enough of Barclycard so I filed a N1 against them for removal of two missed payment markers and damages including court costs £75 and postage etc.... They were served with the papers on 6th April and replied back to court on 9th with defence of full claim. I cannot wait until the day I go to court. I have paper evidence that I did not owe anything for the two months yet they still think they are in the right. I don't expect to win damages for the stress caused as I believe you have to have financial lost and I haven't but I want my credit file cleared. I want my day in court to show Barclaycard that they cannot mess with peoples future. I am hoping though seeing as they only had about two days to look at the paperwork before they filed a defence that when they go to submit their defence they will realise what a mess their customer service staff have made. Any advice as this was nothing to do with bank charges just a computer error on their part.

This will get sorted, by one means or another. You could still send the letter to Varley's office, amending it to show that you have already started court action. It may lead them to resolve the case for you more quickly.
