      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Adding the possibility that at any time your credit line may be decreased, or stopped all together, even when travelling, makes the card more of a liability than a benefit. With Barclays issuing the Black Card with Visa, and many other credit card having much more effective mileage and points programs, an area where American Express has really dried up in lately, there is little to no reason have one in your wallet. Talk about chickens coming home to roost - aren't they linked up with Bank of America MBNA??
Not that I am aware of! But, you never know!

 

However, Amex have always tried to stay independent, and even have their own Card Authorisation network that is independent of the Visa/Mastercard network.

 

Traditionally, Amex has earned its crust from two main sources: 50% from Merchant Fees from their Global Card Authorisation Network, and 50% from Securitisation of their Cards and Loans.

 

However, their piggy bank ran so dry late last year, that they changed their status in the USA to become a bank. Why? Because that then allowed them to accept deposits from savers, but also allowed them to thrust out their begging bowl to the US Government for around $3.5 Billion of bailout funds. Which was the more important I wonder? :rolleyes:

 

A little bird told me that they are still having a few issues getting money from Securitisation, because that little ruse no longer works as well as it once did.

 

I wonder why? :grin:

Today I went on line to pay my monthly Amex Gold Charge Card - As I have done paid on time every month since Dec 1989. I saw to my suprise a banner at the top of the account summary saying informing me that the Card Account had been cancelled. It would also not let me view the statement nor retrieve any rewards for the 15000 points still outstanding. I have tried to ring Amex but the phone queues are prohibitive at the moment. I use the card every month but as it is a charge card there are no debts and it is always paid off in full. My credit score is good. They have also cancelled the card before the yearly subscription is up. I am sure they can do this if they wish. My issue is they are asking me to pay the balance and the web site won't let me see the statement and they have taken the years subsciption up front and I cannot acess my rewards. Do I have anycome back on their actions.

Hi Sandy, and welcome to CAG! :-)

 

How strange. I can't see anything in the press today. I think you'll have to persevere with the call centre until you get an answer.

 

If you have not defaulted then I can't see why they have cancelled your card, and it's totally unreasonable for them not to let you see the statement, keep your points, and not refund the subscription you have paid. With regard to the statement, anything could be there and you have a right to see what you are supposed to be paying for. Why would you pay any bill without knowing what it was for?

 

Let us know what they say.
