    • Wait for more replies, but that letter to me can be interpreted as a letter before action. Ignoring it can have consequences. The court to impose sanctions for failure in responding to a letter of claim.
    • I'm still pondering/ trying to find docs re the above issue. Moving on - same saga; different issue I'm trying to understand what I can do: The lender/ mortgagee-in-possession has a claim v me for alleged debt. But the debt has only been incurred due to them failing to sell property in >5y. I'm fighting them on this.   I've been trying to get an order for sale for 2y.  I got it legally added into my counterclaim - but that will only be dealt with at trial.  This is really frustrating. The otherside's lawyers made an application to adjourn trial for a few more months - allegedly wanting to try sort some kind of settlement with me and to use the stay to sell.  At the hearing I asked Judge to expedite the order for sale. I pointed out they need a court-imposed deadline or this adjournment is just another time wasting tactic (with interest still accruing) as they have no buyer.  But the judge said he could legally only deal with the order at trial. The otherside don't want to be forced to sell the property.. Disclosure has presented so many emails which prove they want to keep it. I raised some points with the judge including misconduct of the receiver. The judge suggested I may have a separate claim against the receiver?   On this point - earlier paid-for lawyers said my counterclaim should be directed at the lender for interference with the receiver and the lender should be held responsible for the receiver's actions/ inactions.   I don't clearly understand that, but their legal advice was something to do with the role a receiver has acting as an agent for a borrower which makes it hard for a borrower to make a claim against a receiver ???.  However the judge's comment has got me thinking.  He made it clear the current claim is lender v me - it's not receiver v me.  Yet it is the receiver who is appointed to sell the property. (The receiver is mentioned/ involved in my counterclaim only from the lender collusion/ interference perspective).  So would I be able to make a separate application for an order for sale against the receiver?  Disclosure shows receiver has constantly rejected offers. He gave a contract to one buyer 4y ago. But colluded with the lender's lawyer to withdraw the contract after 2w to instead give it to the ceo of the lender (his own ltd co) (using same lawyer).  Emails show it was their joint strategy for lender/ ceo to keep the property.  The receiver didn't put the ceo under any pressure to exchange quickly.  After 1 month they all colluded again to follow a very destructive path - to gut the property.  My account was apparently switched into a "different fund" to "enable them to do works" (probably something to do with the ceo as he switched his ltd co accountant to in-house).   Interestingly the receiver told lender not to incur significant works costs and to hold interest.  The costs were huge (added to my account) and interest was not held.   The receiver rejected a good offer put forward by me 1.5y ago.  And he rejected a high offer 1y ago - to the dismay of the agent.  Would reasons like this be good enough to make a separate application to the court against the receiver for an order for sale ??  Or due to the main proceedings and/or the weird relationship a borrower has with a receiver I cannot ?

    • You could send an SAR to DCbl on the pretext that you are going for a breach of your GDPR . They should then send the purported letter of discontinuance which may show why it ended up in Gloucester and see if you can get your  costs back on the day. It obviously won't be much but  at least perhaps a small recompense for your wasted day. Not exactly wasted since you had a great win  albeit much sweeter if you had beat them in Court. But a win is a win so well done. We will miss you as it has been almost two years since you first started out on this mission. { I would n't be surprised if the wrong Court was down to DCBL}. I see you said "till the next time" but I am guessing you will be avoiding private patrolled car parks for a while.🙂

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Rang DVLA today they aint looked at my results yet. Told me i should ring the end of next week if I aint heard by then. Said they have a 3 week backlog.

that sounds about right totenham-linda they dont rush i waited 3 weeks from my medical as well.

Same here.

 

By the way I failed alt but passed mvc and gamma. my readings were 49, 70 and 91 respectively.

 

ALT was prob due to steriods when I was a prat.

 

 

Try not to worry. I did but there is nowt you can do but wait. Fingers crossed for you.

yes im glad its all over but still got 4 weeks to go til my ban is up and its draging like hell,cant wait to jump in my car,have you had any insurance quotes yet :D

I have been driving for a year as dvla only gave me my licence back for one year and when i got my insurance i went with aa insurance also known as mymotorquote.com. They were recommended to me by my driver rehabilitation course and was the cheapest I found. My insurance last year was a little over 300 quid on an 8 year old car. They took my full no claims into consideration which helped to bring it down even though I had a conviction. I renewed it again in April as this was when my insurance ran out and I'm still driving awaiting dvla decision on my medical again and now it is under 300. I'm still allowed to drive while dvla review my last medical.

 

Hope that all makes sense.

I'm in a similar situation to yourselves except that I've got to wait till the end of July 2010 to get my license back and go through the medical.

I'm not a heavy drinker but go out most weekends and have probably done some damage over the years to my liver!

I am going to take the milk thistle stuff and basically look after myself as much as I can.

After reading this, I can see people passed the medical after 2 weeks of abstaining and 5 months. I'm going travelling in October until May, when I'm coming back to do this medical, reapply and fingers crossed, pass!

I plan on reducing my drinking habits anyway in preparation and am going on a retreat for the last month of my travelling so will abstain for about 6 weeks, longer if necessary.

Clearly, everyone is different but it's about a year way for me and I'm already panicking! I've seen people put gamma results of 91 up and pass but with the recommended results being 50? I know you need to pass 3 of the 4 modules so I guess that is why, but can you tell me what the other modules show?

I'm 26 and have been a regular weekend drinker for about 10 years on and off so fingers crossed, it will all be ok. I'm willing to not be drinking for a couple of months while travelling as it will all be worth it, but just looking for some advice really!

I'm going to ask the doctor for a reading soon to see where I am now and what I'll need to do to get to the acceptable readings.

Any advice anyone can give is greatly appreciated! I want to enjoy my travelling and have a few boozy nights but still take into consideration that I will have to absatin from about March/April.

hello mate i wouldnt panick just yet not if you have a year to go,but the recomended obstainance of alcohol is three months for a heavy drinker,but as for most of us on here give it a bit extra.4,5 months just to make sure,also take milk thistle liquid form its 1mil 3 times a day hope this helps

I can't believe it first they give it back to me for a year and now for 3 years. I only no this cos I rang them but I'm gona ask for a copy of my results and a copy of the protocal they follow which allows them to do this. This seems to only be happening to me!!!! So I will be in this situation again in 3 years time - its madness. I've already completed my ban and paid for my failure to provide but I'm still being punished.

i dont understand how they can do that so next time what 6 years, i would look into that or get a solicitor on it

"The DVLA are entitled to ask you to submit to medicals under the High Risk Offender scheme. If they feel that you are a risk they can require you to submit to medicals. You would only be able to appeal if the DVLA refused to give you your licence. If this happened you would have an automatic right of appeal to the Magistrates' Court local to you. We are able to deal with such a scenario for a fixed fee if you ever find yourself in such a position."

That is a quote I got from a solicitor so I can' appeal as I haven't been refused. Wot a load of bxllxxxx.

how come none of us have to have medicals all the time then,i have been done twice and got my licence back about a month ago with no mention of any more medicals,why do you have to keep having them.

I'm gona ask for a copy of my results but I fink my gamma was about 90 which is quite ova and if one of your results is quite ova then they can demand another medical. I've read that off their dvla website. I fink they have to pay for the medical they did for my last one anyway. I will wait to see what my results were but I reckon thats what the problem is. Oh well in 3 years time I will have to do like you did and give it up for 4 months not 2 months like I did this time and that should bring my results down better.

Had one of my family round helping me decorate last week and he was on the cans from 10am. He was grafting and helping me out so I daint complain. But get this he told me he was on a ban awhile ago and had a medical and reckons the day of the medical he had 2 cans and a line before and he passed!

A three-year licence is not too much of a problem. I've had them for about nine years, now.

My only gripe is being limited to vehicles 3.5 tons or less.

Hi All

 

Just found this site/thread after googling.

 

Anyway i am in the same position as some on here but worried. I had 18 month ban and refused breathalyser.

 

My ban is up Oct 5th.

 

I went for my medical on 27th July which was pathetic, lasted 10 mins taken blood/urine test and the 40 questions, oh plus BP which was 110/75. Had not drunk for 5 months upto this !!!

 

Was told would have some results from DVLA within 2 weeks by Dr.

 

Anyway had phone call from medical centre saying my blood had clotted and i would have to give another sample !!!So went back on the 29th July.

 

Waited 2 weeks and nothing so rang DVLA on 14th Aug and they said they had received results that day and they had been passed onto the medical investigators/board !!!

 

Now this got me worried....

 

Rang again today on the 18th August and they said it showed on their system that they had applied for information/report from my local GP...

 

Anyone else experienced this as i am now worried what is going on..
