Help Please with Nat West Terminology - Is Yourbank around??

Any thoughts as to where best to send a request for a refund of monies paid via a third party (collection agents) to NAT WEST. The funds were paid over a number of years, but all the while they've had no agreement and have admitted this.

 

As soon as I requested copies of signed agreements from the colletion agents they immediately returned the account to NatWest. Nat west have since admitted there is no agreement. Obviously since then I've not made any further payments!!

 

Having only been aware of consumer rights (thank you very much CAG :)) for about the past two years, have now decided to take these lot on!!! It could be a biggie :-o

 

.... and very interesting if I get a good result (although i won't hold my breath!!)

 

Been dealing with NatWest in Telford, but not sure if this is the best place to write for a refund given that it is an "archive" account.

 

Is "yourbank" around at the mo????

Have been offered the difference between the £20 and £12 charges from Capital One -- am sending LBA for remainder.

GE Money - Received settlement of £441, being total charges requested. No interest though.

CCA'd Bank of Scotland / Blair Oliver Scott to produce CCA Agreements on two Credit Cards - well in default, although still chasing payment!!!

EOS Solutions "ceased action on account" on behalf of a friend.

 

All in all, quite busy at the moment and enjoying every minute of it

Good luck mate and remember to send your letter by recorded mail so that you can proove that the bank received it etc. And when NatWest lift the block on charges we will be in the que to get paid out first. I am currently in the process of claiming charges on 3 Natwest accounts for myself. Got 6 years worth of statment through today in post for one account and NatWest owe me just over £250 on one account only lol so i cant wait to get the other statments and work the charges out there. And if you get no luck with NatWest then I'd take this matter to County Court which you can aslo do online now.

Hi -- it's not charges that I'm trying to claim back. it's monies i paid to them, via a third party, off a large old business debt. They have no signed papers to back up anything, so I'm attempting to reclaim what I've paid. As I said, it would prove very interesting were I to get anything back. In any case, I'll not be paying anything more to them!!

 

I know there's been a few successes with reclaiming money paid to third parties, but as the third party have passed it back to nat west, I;m now just wondering if I should try to claim back from the third party, given that it was them that I paid??

 

Any more thoughts peeps???

Hi - just received a response from NatWest, to a SAR equest. Despite them knowing my address, and communicating with them since July of this year from that address, they want me to go into Branch with utility bill to confirm the address and ..... wait for it ...... they also want to update my signature, so do I need to go in and sign.

 

Anyone know if this is right or has anyone had to do anything similar in order to get the SAR info???

NO!

Do not sign anything. As I see it they want your signature. someone with more BA**S will tell you why.

They have been quite happily sending you statements to your home address so why would they now be balking at sending your SAR? Alterior motives???

Just been having a think.

If Natwest are being stubborn then you can provide a signature but put a couple of lines through it so that it's distinctly different from your normal signature.

I'm not saying natwest would do this but it has been known for certain institutions to "lift" your signature and copy it to an agreement.

Just what I thought ...... I want something with my signature on ....... and they want me to sign in branch to sign my current signature ......... they might think I was born yesterday, but I wasn't and I have the wrinkles to prove it :eek:

If they have sent you bank statements to that address for a number of years, the Information Commissioners Office view is that it is not necessary. However, if you have no relationship whatsoever with the bank then they would need to see some identification.

I do think as well that your signature is probably not on file(we have somewhere to check that and sometimes it does say "signature not on file"--partially it relates to the changeover of NatWest systems to NatWest). I would await until you have received a CCA requested and resolved all issues prior to updating it, if at all.

I've received part of a subject access request from Nat West, it's a Security Event History sheet, all in their internal shorthand.

 

They've not provided me with any explanation, but here are some of the codes, can anyone help with translation??

That is non compliance with a SAR as the format has to be accompanied by terminology that explains what those definitions means. I have to admit that I don't understand the terminology that they are using. Had the first term said CUI and an amount then yes I think I understand that as being a cheque that someone paid to you being returned unpaid. Need to have a think about those terms but I think a letter might be in order to Retail Regulatory Risk about SAR and that terms needs to have an explanation for them to be compliant with them.
