    • Update: tfl is taking me to court I'm trying to get an ooc claim from them but they have not been replying to my emails. 
    • Are these the important pages I need to upload ? 1.  pages 1-4 are court form 10a 2.  2 pages of the CCA agreement  3.  Default notice from NewDay, 22/02/20 4.   Lowell letter stating they own debt ,     Dated 16/11/20 5. Unheaded letter also dated 16/11/20 from NewDay saying they assigned “all of the respective rights etc,”  to Lowell on 23/10/20 I make this 9 relevant pages from what I can see   ( all other pages are statements/default notes and lots of FCA info sheets) just needing your confirmation in advance as I don’t want to send over pages that are not required thank you  UCM      
    • Just out of curiosity aesmith - are you a lawyer?
    • I spoke to a pro-bono entity this afternoon.  They advise I must initiate a claim in the court v the receiver if I want to then file an application for an order for sale.  I must have a claim/ proceedings to be able to force a sale. The judge in the current proceedings  has told me that I cannot force the lender to sell and the lender cannot interfere either.   If the receiver isn't acting correctly and isn't selling - this means I must make a claim against the receiver I could initiate a claim. Or much quicker  - the other entity - with a charge already - could use that to make an application for an order for sale.
    • Thanks Dave It's not too far away, about 8 or 9 miles, so I will probably venture over on my bike if I can't think of a good reason to drive there again! I'll have a chat with Mrs GB_Joe tomorrow and see which shops they visited, I know M&S was on the list (had to try on multiple sets of trousers!) and they are actually in that bit of retail park. The uniform shop is across the way in the Meridian Centre, so probably not helpful to get them involved.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Guys,

 

I have just had a letter through this morning from Cabot Financial claiming that I owe £6000 from a barclays account.

 

I have not been a barclays customer for a good 10 years now.

 

I am not sure what exactly the debt is but am now a little worried about this. I may call them today but am reluctant to do this as I know what these sort of people are like on the phones.

 

Cqan anyone advise what my first steps should be please?

Your first step would be NOT to phone them.

 

Debts become statute barred if they haven't been acknowledged for 6 years. I would send them template M here via recorded delivery. Conduct all future communication in writing only.

Hi Tezviper ............... No real need for a CCA request at this point. Just send them the Stature Barred letter.

As drob says there is no need for the CCA request at this stage. You certainly don't want to waste a whole pound on these people unless you really have to ;)

Hi All,

 

This has kind of crept up on me again.

 

I split from my partner not long after original post and never thought twice about it, anyway I have been given a letter today which was sent to the old house which is basically court papers stating they are chasing the money.

 

I am basically wonder what I should do now.

 

Is it worth me sending a CCA or should I acknowledge the claim and fil defence as it being statute barred???

 

Any help appreciated and will definately be acting on it.

I don't know enough about court cases but I think you have to acknowledge it and you will want to be defending in full. You should be able to acknowledge online at MCOL but make sure you do before the time runs out.

If your 100% its been over 6 years without written acknowldgement or payment then defense would be SB and as they have commenced legal proceedings then you can go down the CPR route to get docs from them. Somebody with more knowldged prob be along soon. Might help to post up their POC so someone can have a look over them. Is it geniune court papers they have sent. Scan what they have sent taking out personal details.

Well as you said in your first post, this debt is 10 years old therefore it's statute barred under the Limitation Act. That's a complete defence in itself.

Hi All,

 

AM planning on responding to the claim tomorrow.

 

POC is as follows ;

 

The Claimant is part of the Cabot financial group and has purchased the debt(s) scheduled below. Despite requests for payment the Defendant has failed to pay the sum of £5914.39 in rekation to the Defendant's Barclays Bank Plc BARCLAYS BANK ACCOUNT number ****** And the claimant claims: the sum of £6204.39 together with interest under section 69 of the county courts act 1984 ; and costs.

 

 

That is the exact wording, I have just noticed that the account number contains only 6 digits when I am sure it contained 8 but not sure if thats at all relevant.

 

I am going to dispute the whole claim and just wondered what sort of wording I should use if going to take statute barred route, would they then have to prove that it isn't statute barred?

 

I dont think they have given much infp either.#

 

Any advice welcome please

Your best option would be to write them about it if for anything else, not to come into contact with them directly. It helps you sort things out when they're not running circles around you with what you can and can't do.

the first thing you need to do is acknowledge the claim and state thet you will be defending all of the claim. This then gives you time to file a defence. I don't know which cpr rules apply but if you have a read around you will be able to gewt some idea.

You will need to use the cpr to get everything the DCA will be using in their case against you.

Check out the Limitations Act as this will give you some idea on the Statute barred defence

Hi Tez...and thanks Foxy for pointing me towards this....this is a shocker and when you fight this and win, then you MUST report them to the OFT...please try and stick to the timetables, get that defence in, please have a look at these here, as this will assist you GREATLY....

Dear sir/madam

 

I am in receipt of your court claim, which is evidently barred by the statute of limitations act.

 

For the record I will be setting this aside and claiming my costs in court, if you discontinue I will also apply to the court for a wasted costs order. I will be forwarding this unlawful claim to the Office Of Fair Trading also.

I have now filed my defence to the claim using some advice given in the thread you directed me too, many thanks for that.

Rather randomly, I have just had a text on my phone from IQor!! telling my payment is due shortly??

 

I have ahad a look and this is a tactic that Cabot use!! Does that sound right?

Hi all,

 

I have just checked with MCOL and it has been 30 days since I filed my defence against the claim.

 

Can anyone asdvise if that will now be closed or is it more than 28 days allowed from date of defense being filed.
